NOTICE OF DIRECTIVE

Please accept this letter as my direction under section 6 of the Crown Counsel Act. This directive may be cited as the Provincial Firearms and Other Weapons Amnesty Period directive.

Immunity:

Subject to the limitations described herein, this directive creates an immunity from prosecution for the offences contained in sections 91, 92, 93 and 95 of the Criminal Code of Canada for those persons who willingly surrender firearms or other weapons or ammunition in their possession to the police during the amnesty period noted below. The purpose of this limited amnesty period is to provide members of the public who possess illegal or unwanted firearms, weapons, ammunition or prohibited ammunition an opportunity to voluntarily dispose of such items safely and lawfully, without fear of criminal prosecution.

Amnesty Period:

The period beginning at 12:01 am on Saturday, October 1, 2016, and ending at 11:59 pm on Monday, October 31, 2016, will be an amnesty period in respect to any person who contacts the police and voluntarily surrenders to them any firearm, prohibited firearm, restricted firearm, prohibited weapon, restricted weapon, prohibited device, or prohibited ammunition.

Limitations:

The immunity from prosecution set out in this direction does not apply to anyone who when detained or arrested by the police is found to be in possession of a firearm, weapon, prohibited device or prohibited ammunition. Moreover, the immunity is not applicable if it is determined that a firearm, weapon or device that was voluntarily surrendered has been used for a criminal purpose.
