COURT BAILIFF SALE OF LAND

In the Supreme Court of British Columbia Vancouver Registry, Action No. S-121193 between University of British Columbia (Plaintiff) and Miroslaw Moscipan in his personal capacity of Executor of the estate of Wanda Barbara Moscipan, Deceased, and Brian Moscipan (Defendants).

By virtue of an “Order Made After Application” issued out of the Supreme Court of British Columbia Vancouver Registry, Action No. S-121193, before the Honorable Justice Thomas, on the 14th day of April 2025, and entered on the 14th day of April 2025. The Sheriff/Court Bailiff will commence to sell by M.L.S. (Commencing June 12, 2025). The Estate’s interest in the Lands and Premises commonly known as 3328 Tennyson Crescent, North Vancouver, British Columbia and Legally described as:

Lot 13, Plan VAP14014, District Lot 2003, Group 1, New Westminster District, PID: 007-959-338 (The Property) to recover $1,534,860.07 plus Post-Judgement Interest and costs in an amount to be assessed pursuant to the order made by the Honorable Justice Taylor on February 23, 2024.

CONDITIONS OF SALE:

1. Upon this Honorable Court Approving the Sale price of the property and upon a payment by the purchaser or his/her agent of the Sale price for the property, the Sheriff shall deliver to the purchaser a conveyance of the property and immediately upon registration of the transfer in the Vancouver land Title Office, the Purchase will recover possession of the property so conveyed to the purchase;

2. The proceeds from the Sale of Property shall be distributed, subject to the provisions of the Creditor Assistance Act, R.S.B.C. 1996, c.83 as follows:

a. taxes, arrears of taxes, water rates and the like (if any);

b. the fees and costs incurred by the Sheriff incidental to the sale of the property, including the commission of the real estate agent engaged by the Sheriff;

c. The remainder of the proceeds (the “net proceeds”), if any, be paid to the registrar of this Honorable Court to the credit of this proceeding;

d. The net proceeds be paid out of this Honorable Court upon further application by UBC and Vancouver Coastal Health Authority with respect to the judgement entered against the Estate and the Assessed costs arising from this action and companion action no. S-121908;

e. The Sheriff reserves the right to reject any or all offers and further reserves the right to adjourn the sale generally;

f. The Sheriff makes, and it shall be deemed to have made, no representation of warranty whatsoever with respect to any matter of this Sheriff sale, express or implied, statutory or otherwise, and the purchaser is submitting an offer to purchase on an “As Is, Where Is” basis, at its own risk and peril, and without limiting the generality of the foregoing in all that matters the purchaser shall satisfy themselves. The Purchase(s) are also responsible for any and all applicable taxes pertaining to their purchase. The Purchaser(s) are also responsible for any costs incurred by the Purchaser(s);

g. A court order approving the sale is required.
