B.C. Reg. 43/2006, deposited March 16, 2006, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [Section 35] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]. Order in Council 143/2006, approved and ordered March 15, 2006.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Employment and Assistance Regulation, B.C. Reg. 263/2002, and the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, are amended in accordance with the attached Schedule.

Schedule

1 The Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended in section 3 of Schedule B by repealing subsection (2) and substituting the following:

(2) The exempt amount for a family unit that qualifies under subsection (1) is calculated as the lesser of the family unit's total earned income in the calendar month of calculation, and

(a) $300 in the case of a family unit that is composed of a sole recipient described in subsection (1) (c) (ii), or

(b) $500 in the case of a family unit described in subsection (1) (c) (i).

2 The Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended in section 3 of Schedule B by repealing subsection (2) and substituting the following:

(2) The exempt amount for a family unit that qualifies under subsection (1),

(a) in the case of a family unit that is composed of one recipient who is designated as a person with disabilities, is calculated as the lesser of

(i) $500, and

(ii) the family unit's total earned income in the calendar month of calculation, or

(b) in the case of a family unit that is composed of two recipients, both of whom are designated as persons with disabilities, is calculated as the lesser of

(i) $750, and

(ii) the family unit's total earned income in the calendar month of calculation.
