LOCAL GOVERNMENT AMENDMENT ACT, 2016

This Bill will ensure that municipalities in British Columbia cannot be incorporated without ensuring that there are first residents actually living in the area at the time of incorporation.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 8 of the Local Government Act, R.S.B.C. 2015, c. 1, is amended by

(a) by repealing subsection (3),

(b) in subsection (4) by striking out "or (3)",

(c) by repealing subsections (5) and (6), and

(d) in subsection (7) by striking out "and unless the letters patent for a mountain resort municipality incorporated under subsection (6) provide otherwise," and in paragraph (a) by striking out "under that subsection".
