Preamble

WHEREAS the Commission constituted under section 9 of the "United Church of Canada Act," the members of which were duly appointed by Order of the Lieutenant-Governor in Council No. 1389, approved on the thirtieth day of December, 1925, has presented its report pursuant to that section:

AND WHEREAS, in order to make an equitable adjustment of the congregational properties referred to in said section 9, as recommended by the report of the said Commission, it is deemed expedient to enact as follows:

THEREFORE, HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:—

Short title

1   This Act may be cited as the"United Church of Canada Act Amendment Act, 1927."

1926/27-74-1.

St. Andrew's Church, Duncan, B.C.

2   All and singular that certain parcel or tract of land described as Lot 6, Block 3, Quamichan District, according to Registered Plan No. 798, is hereby vested in The Presbyterian Extension Association, in trust, for the use of the Duncan Congregation of the Presbyterian Church, subject to any registered charges thereon, and also subject to a charge thereon, which is hereby created, for the sum of two hundred and fifty dollars in favour of the United Church of Canada, to be held in trust for the use of the Duncan Congregation of that Church, said sum to be payable on the tenth day of August, 1927, and to bear interest after that date at the rate of seven per centum per annum until paid.

Hollywood Mission, Victoria, B.C.

3   All and singular that certain parcel or tract of land lying and being in the City of Victoria, and known as Lot 14, Block 5, Registered Map No. 970, is hereby vested in The Presbyterian Extension Association, in trust, for the use of the Hollywood Mission of the Presbyterian Church, subject to any registered charges thereon.

Vancouver Heights, Vancouver, B.C.

4   Lots 11 and 12 of Block 2 of North Half of District Lot 116, Map 1236, are hereby charged with the sum of twelve hundred and fifty dollars in favour of The Presbyterian Extension Association, to be held in trust for the use of the Vancouver Heights Congregation of the Presbyterian Church, said sum to be payable on the thirty-first day of March, 1927, and to bear interest after that date at the rate of seven per centum per annum until paid.

Salmon Arm, B.C.

5   Lots 4 and 5, Map 667, City of Salmon Arm, are hereby vested in The Presbyterian Extension Association, in trust, for the use of the Salmon Arm Congregation of the Presbyterian Church, subject to any registered charges thereon, and also subject to a charge thereon, which is hereby created, for the sum of five hundred and fifty dollars in favour of the United Church of Canada, to be held in trust for the use of the Salmon Arm Congregation of that Church, said sum to be payable on the thirty-first day of March, 1927, and to bear interest after that date at the rate of seven per centum per annum until paid.

Armstrong, B.C.

6   Lots 1 and 2 of Block 15, Map 408, Town of Armstrong, are hereby charged with the sum of one thousand dollars in favour of The Presbyterian Extension Association, to be held in trust for the use of the Armstrong Congregation of the Presbyterian Church, said sum to be payable on the thirty-first day of March, 1927, and to bear interest after that date at the rate of seven per centum per annum until paid.

Newton, B.C.

7   Lot 2 of Lot 20 of the East Half of the North-east Quarter of Section 17, Township 2, New Westminster District, Map No. 2962, is hereby vested in The Presbyterian Extension Association, in trust, for the use of the Newton Congregation of the Presbyterian Church, subject to any registered charges thereon.

Broadview, B.C.

8   Lot 6 of Block 31 of Lot 69, Group 1, New Westminster District, Map 1321, is hereby vested in The Presbyterian Extension Association, in trust, for the use of the Broadview Congregation of the Presbyterian Church, subject to any registered charges thereon.

Kamloops, B.C.

9   Lot 6, Block 11, Map 193, Kamloops Division, Yale District, shall on the thirty-first day of March, 1927, become and be vested in The Presbyterian Extension Association, in trust, for the use of the Kamloops Congregation of the Presbyterian Church, subject to any registered charges thereon.

Grand Forks, B.C.

10   Lots 7 and 8, Block 18, Map 23, Grand Forks Townsite, together with all furniture contained in the church erected on the said property, except the piano, are hereby vested in The Presbyterian Extension Association, in trust, for the use of the Grand Forks Congregation of the Presbyterian Church, subject to any registered charges thereon.

Murrayville, B.C.

11   Lot 3, Block 14, of part of the South-west Quarter of Section 6, Township 11, New Westminster District, Map 1551, is hereby vested in The Presbyterian Extension Association, in trust, for the use of the Murrayville Congregation of the Presbyterian Church, subject to any registered charges thereon, and also subject to a charge thereon, which is hereby created, for the sum of one hundred dollars in favour of the Rev. T. R. Peacock, his executors, administrators, and assigns, said sum to be payable on the thirty-first day of March, 1927, and to bear interest after that date at the rate of seven per centum per annum until paid.

Nanaimo, B.C.

12   Lots "A," "B," "C," "D," "E," "F," "H," "J," and "I," as shown on a plan of subdivision of part of Block 28, Section 1, Nanaimo District, made by Alfred G. King, B.C.L.S., on the twenty-fourth January, 1927, and deposited in the Land Registry Office in the City of Victoria, under document file No. 16273, shall on the thirty-first day of March, 1927, become and be vested in Alexander Rowan, William Carmichael, Alexander Fraser, and James Cowie, and their successors to be elected in accordance with the rules and forms of procedure of the Presbyterian Church, in trust, for the use of the Nanaimo Congregation of the Presbyterian Church, subject to any registered charges thereon, and subject to the use by the United Church of Canada of the parsonage situate on lands so vested until the thirtieth day of June, 1927.

Central Church, Vancouver, B.C.

13   Lots 10 and 11, Block 9, District Lot 185, Group 1, New Westminster District, Plan 92, together with all furniture contained in the buildings situate thereon except the radio equipment, shall on the thirty-first day of March, 1927, become and be vested in Robert John Taggart, William Izett Walker, and Leslie Gilmore Henderson, and their successors to be elected in accordance with the rules and forms of procedure of the Presbyterian Church, in trust, for the use of the Congregation of the Central Presbyterian Church, Vancouver, subject to any charges registered thereon as at the date of the passing of this Act, and subject to the payment of the balance of purchase-moneys and interest due in respect of the organ situate in the church on lands so vested.

Trust powers conferred on The Presbyterian Extension Association

14   The Presbyterian Extension Association, being an association incorporated under the "Societies Act," is hereby empowered, notwithstanding the provisions of the "Trust Companies Act," to accept and execute the several trusts entrusted to it by this Act, and in the execution of such trusts to hold and dispose of the respective properties vested in it by this Act.

15   This Act shall be construed as an amendment of the "United Church of Canada Act."
