WHEREAS British Columbia Power Commission owns and operates diesel-electric generating plants and electrical distribution systems serving the Villages of Hope and Lillooet, and the areas adjacent thereto, together with an electrical transmission-line from Jones Creek to Hope:

AND WHEREAS British Columbia Electric Company Limited has offered to purchase the said plants, systems, and transmission-line:

AND WHEREAS it is expedient to authorize British Columbia Power Commission to sell the said plants and systems to British Columbia Electric Company Limited:

THEREFORE, HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:—

Short title

1   This Act may be cited as the "Hope and Lillooet Electrical Systems Sale Act."

Interpretation

2   In this Act, unless the context otherwise requires:—

"Commission" means British Columbia Power Commission:

"Company" means British Columbia Electric Company Limited:

"Plant" shall have the meaning given to it by the "Electric Power Act."

Authorizes sale of plants at Hope and Lillooet

3   The Commission is authorized to sell and dispose of all of the Commission's plant at the Village of Hope and at the Village of Lillooet, and in the areas adjacent thereto, together with the Commission's electrical transmission-line from Jones Creek to Hope, to the Company, at a price first to be approved by the Lieutenant-Governor in Council, which shall not be less than the full amount of the Commission's investment therein less the sinking fund reserves and the maintenance and renewal reserves provided by the Commission therefor.

Section 63 of "Electric Power Act" not to apply

4   Upon the sale and disposal of the said plant, the Commission shall not be liable thereafter under the provisions of section 63 of the "Electric Power Act" to pay to the Villages of Hope or Lillooet, or to the Province, the taxes exigible from the undertaking during the year 1944.

Commission released from obligation to supply power at Hope and Lillooet

5   Upon the disposition and sale authorized by this Act, the Commission shall be released from any obligation relating to the purchase or supply of electrical power or energy at Hope, Lillooet, or in the areas served by the Commission's plants at Hope and Lillooet.
