An Act to Validate the Title to Special Timber Licences

WHEREAS The Timber Investment Company, a corporation registered as an extra-provincial company within the Province, was registered in the Forest Service of the Department of Lands and Forests on or about the twenty-fifth day of April, 1908, as the owner of Special Timber Licences 4370 to 4378 (both inclusive), 4380 to 4393 (both inclusive), 4408, 4409, 4411 to 4421 (both inclusive), and 4436 to 4439 (both inclusive), and on or about the first day of November, 1910, as the owner of Special Timber Licences 4394 to 4397 (both inclusive) and 4399 to 4407 (both inclusive):

AND WHEREAS on or about the twenty-second day of February, 1914, the said The Timber Investment Company was stricken from the register of companies for failure to file its annual returns:

AND WHEREAS the said The Timber Investment Company was again registered as an extra-provincial company within the Province on the twenty-second day of December, 1950:

AND WHEREAS on or about the twenty-second day of December, 1950, the said The Timber Investment Company assigned the last-mentioned special timber licences to Powell River Company Limited:

AND WHEREAS on or about the third day of January, 1951, the said Powell River Company Limited assigned certain of the last-mentioned special timber licences — namely, 4385, 4402 to 4409 (both inclusive), 4411 to 4421 (both inclusive), and 4436 to 4439 (both inclusive) — to Canadian Forest Products Limited:

AND WHEREAS the annual licence fees and Forest Protection Fund in respect of all of the said special timber licences have, since the twenty-second day of February, 1914, been paid in each year on or before their respective due dates, and no annual fees or Forest Protection Fund in respect of the said special timber licences are in arrear:

AND WHEREAS the said Special Timber Licences 4370 to 4378 (both inclusive), 4380 to 4384 (both inclusive), 4386 to 4397 (both inclusive), and 4399 to 4401 (both inclusive) are registered in the name of Powell River Company Limited in the said Forest Service, and the said Special Timber Licences 4385, 4402 to 4409 (both inclusive), 4411 to 4421 (both inclusive), and 4436 to 4439 (both inclusive) are registered in the name of Canadian Forest Products Limited in the said Forest Service:

AND WHEREAS it is desirable to remove any doubt respecting the title to the said special timber licences that may be caused by the fact that The Timber Investment Company was not registered as an extra-provincial company within the Province during the period from the twenty-second day of February, 1914, to the twenty-second day of December, 1950:

THEREFORE, HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Short title

1   This Act may be cited as the "Special Timber Licences Validating Act."

Validation of title

2   (1) It is hereby declared that Powell River Company Limited has a good title to the said Special Timber Licences 4370 to 4378 (both inclusive), 4380 to 4384 (both inclusive), 4386 to 4397 (both inclusive), and 4399 to 4401 (both inclusive), subject to the terms and conditions of the said special timber licences and the provisions of the "Forest Act," notwithstanding that The Timber Investment Company, its predecessor in title, was not registered as an extra-provincial company in the Province during the period from the twenty-second day of February, 1914, to the twenty-second day of December, 1950.

(2) And it is hereby declared that Canadian Forest Products Limited has a good title to the said Special Timber Licences 4385, 4402 to 4409 (both inclusive), and 4411 to 4421 (both inclusive), and 4436 to 4439 (both inclusive), subject to the terms and conditions of the said special timber licences and the provisions of the "Forest Act," notwithstanding that The Timber Investment Company, one of its predecessors in title, was not registered as an extra-provincial company in the Province during the period from the twenty-second day of February, 1914, to the twenty-second day of December, 1950.

3   It is hereby declared that the said special timber licences are valid and subsisting special timber licences in full force and in good standing.
