Assented to October 17, 1953
WHEREAS on the third day of September, 1953, The Corporation of the City of Victoria had on hand the sum of one hundred and fifty thousand dollars, being moneys received from the sale of tax-sale properties:
AND WHEREAS the Corporation, by By-law No. 3927, passed by the Municipal Council of the Corporation on the third day of September, 1953, and assented to by the electors of the Corporation on the seventeenth day of September, 1953, and finally passed by the Council on the fifth day of October, 1953, authorized the expenditure of the said sum of one hundred and fifty thousand dollars as a contribution towards the construction of a nursing home by the Victoria Nursing Home Society, a society incorporated under the "Societies Act" of the Province of British Columbia:
AND WHEREAS it is deemed expedient and in the best interests of the Corporation to remove any doubt as to the validity of the said by-law:
THEREFORE, HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:—
1 This Act may be cited as the "Victoria City By-law No. 3927 Validation Act."

2 Notwithstanding anything contained in the "Municipal Act" or any law to the contrary, By-law No. 3927 of The Corporation of the City of Victoria, entitled "Tax Sale Lands Moneys Application By-law No. 1, 1953," passed by the Municipal Council on the third day of September, 1953, and having received the assent of the electors on the seventeenth day of September, 1953, pursuant to Order in Council No. 2085, approved by His Honour the Lieutenant-Governor in Council on the ninth day of September, 1953, and finally passed by the Council of the Corporation on the fifth day of October, 1953, as set forth in the Schedule hereto, is hereby declared to be a valid and binding by-law, and no liability shall attach to any person under section 537 of the "Municipal Act" arising from the passing of said by-law or from the Treasurer paying over and applying the several sums of money (not to exceed one hundred and fifty thousand dollars) in accordance with the terms of the said by-law.

No. 3927
A By-law to authorize the Expenditure of $150,000.00 being in part Moneys received during the Year
1952 from Sales of Tax Sale Lands and in part the Unexpended Balance of Proceeds from Tax Sale
Lands during the Year 1951.
WHEREAS during the year 1952 there was received from the sale of tax sale properties the sum of Ninety-four Thousand Six Hundred Seventy Dollars and Eighteen Cents ($94,670.18);
AND WHEREAS the said sum was set aside and deposited in the Bank of Montreal, at 1225 Douglas Street, Victoria, in an account called the Tax Sale Lands Account;
AND WHEREAS there is on hand in the account known as Tax Sale Lands Account the further sum of Eighty-two Thousand Five Hundred Dollars ($82,500.00) being the unexpended balance of the proceeds received during the year 1951 from the sale of tax sale properties;
AND WHEREAS it is deemed expedient to expend for the purposes hereinafter mentioned the said sum of Eighty-two Thousand Five Hundred Dollars ($82,500.00) together with the sum of Sixty-seven Thousand Five Hundred Dollars ($67,500.00) being a portion of the aforesaid sum of Ninety-four Thousand Six Hundred Seventy Dollars and Eighteen Cents ($94,670.18) and making in all a total sum of One Hundred Fifty Thousand Dollars ($150,000.00);
AND WHEREAS the Corporation's indebtedness consists entirely of serial debentures;
AND WHEREAS application has been made to the Lieutenant-Governor in Council for approval of this by-law pursuant to the provisions of Subsection (2) of Section 537 of the "Municipal Act":
NOW THEREFORE the Municipal Council of The Corporation of the City of Victoria enacts as follows:
1. That the above-recited sum of One Hundred Fifty Thousand Dollars ($150,000.00) be expended as The Corporation of the City of Victoria's one-third contribution towards the construction of a nursing home to accommodate one hundred and four (104) beds in conjunction with the Dominion Government and the Provincial Government by the Victoria Nursing Home Society, being a Society incorporated under the "Societies Act" of the Province of British Columbia. Provided, however, as consideration for the payment of the said One Hundred Fifty Thousand Dollars ($150,000.00) as aforesaid the Victoria Nursing Home Society will enter into an agreement with the said Corporation whereby it will agree to make available for the said Corporation eighty (80) beds for the Corporation's patients, and, inter alia, that it will be financially responsible for all costs and expenses over and above what the Provincial Government and the said Corporation are called upon to pay, whether it be eighty (80%) per cent and twenty (20%) per cent respectively or such other percentage amounts as may from time to time be determined.
2. This By-law shall not come into force unless it is passed by a three-fourths majority of all the members of the Council and unless and until it has been approved by the Lieutenant-Governor in Council.
3. This By-law may be cited as "Tax Sale Lands Moneys Application By-law No. 1, 1953."
Passed by the Municipal Council the 3rd day of September, A.D. 1953.
Received the assent of the electors the 17th day of September, A.D. 1953.
Reconsidered, adopted and finally passed by a three-fourths majority of all the members of the Council the 5th day of October, A.D. 1953.
