WHEREAS "The Corporation of the City of Ladysmith, B.C. Rates and Percentages By-law 1955," was reconsidered, adopted, and finally passed by the Municipal Council on the twenty-seventh day of April, 1955, being By-law No. 315:

AND WHEREAS the said by-law provided that the tax rate be imposed and levied upon fifty per centum of the rateable improvements for school purposes:

AND WHEREAS, by section 264 of the "Municipal Act," as amended by the Statutes of 1955, the rate to be imposed upon improvements for school purposes is upon seventy-five per centum of the assessed value thereof:

AND WHEREAS the error was due to an oversight:

AND WHEREAS it is deemed expedient to validate the said by-law:

THEREFORE, HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:—

Short title

1   This Act may be cited as the "City of Ladysmith By-law No. 315 Validation Act."

Validation of by-law

2   Notwithstanding anything contained in the "Municipal Act" or any law to the contrary, By-law No. 315 of The Corporation of the City of Ladysmith, cited as "The Corporation of the City of Ladysmith, B.C. Rates and Percentages By-law 1955," passed by the Municipal Council on the thirteenth day of April, 1955, and reconsidered, adopted, and finally passed by the Municipal Council on the twenty-seventh day of April, 1955, as set forth in the Schedule hereto, is hereby declared to be a valid and binding by-law.

THE CORPORATION OF THE CITY OF LADYSMITH

By-law No. 315

A By-law to fix the Rates and to authorize the Levying of Taxation upon Real Estate and Improvements within the Municipal Area of the City of Ladysmith, B.C., for the year 1955.

WHEREAS it is necessary to fix Rates of Taxation upon Real Estate and Improvements within the corporate area of The Corporation of the City of Ladysmith, B.C., the Municipal Council of The Corporation of the City of Ladysmith enacts as follows:—

1.  There is hereby settled and imposed and levied, and there shall be collected an equal rate of Eight Mills (8) on the Dollar upon all the Land, and upon Fifty per cent (50%) of the Improvements described upon the Assessment Roll of The Corporation of the City of Ladysmith at the assessed value thereon for GENERAL PURPOSES.

2.  There is hereby settled and imposed and levied, and there shall be raised and collected an equal rate of Twenty-two Mills (22) on the Dollar upon all rateable Land and upon Fifty per cent (50%) of the rateable Improvements described upon the Assessment Roll of The Corporation of the City of Ladysmith at the assessed value thereon for SCHOOL PURPOSES.

3.  The Collector of The Corporation of the City of Ladysmith shall respectively, on the first day of each of the months of August, September, October, November, and December in the year 1955, add to the taxes of the current year remaining unpaid in respect of each and every parcel of Land and Improvements upon his Roll, an addition of Two per cent (2%) of the amount thereof.

4.  The aforesaid Rates and Taxes shall be due and payable to the Collector of The Corporation of the City of Ladysmith at his office at the corner of Roberts Street and Esplanade, in the City Hall, in the City of Ladysmith, on or before the thirty-first day of July 1955.

5.  The aforesaid Rates and Taxes shall be due and payable upon the coming into effect of this By-law, which shall be upon the final passage thereof and registration in the office of the Registrar of the County Court for the County of Nanaimo in the Province of British Columbia.

6.  This By-law may be cited for all purposes as "The Corporation of the City of Ladysmith, B.C. Rates and Percentages By-law 1955."

Passed the Municipal Council the 13th day of April, 1955.

Reconsidered, adopted, and finally passed by the Municipal Council this 27th day of April 1955 a.d.
