Assented to April 6, 1968
WHEREAS, by the deposit of a subdivision plan, numbered 2938, in the Land Registry Office at Nelson, certain lands at Brilliant, in the Kootenay District, were deemed, by virtue of section 112 of the Land Registry Act, to have been dedicated to the public as a park and title thereto vested in the Crown in right of the Province, which park now consists of the lands described in the Schedule to this Act:
AND WHEREAS, at the time of such dedication, the tomb of Peter Verigin was situated within the present limits of the park, and the members of The Union of Spiritual Communities of Christ, having constructed the tomb, have since maintained it, together with the surrounding gardens and works therein:
AND WHEREAS it is fitting that the lands which now comprise the park be transferred to and vested, as hereinafter appears, in The Union of Spiritual Communities of Christ, a society incorporated under the Societies Act:
THEREFORE, HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:—
2 (1) The lands described in the Schedule to this Act are, by virtue of this Act, transferred to and vested in The Union of Spiritual Communities of Christ, being the society of that name incorporated under the Societies Act, free and discharged from the dedication or trust imposed by section 112 of the Land Registry Act, but subject to the provisions hereof.
(2) The said lands shall vest in The Union of Spiritual Communities of Christ in trust to maintain thereon the tomb of Peter Verigin and the tombs or interments, as the case may be, of the individuals listed in the Appendix to this Act and, if applicable, of the individuals listed in subsection (2.1) and, to the extent consistent therewith, for the purposes of a public park only, subject to the exceptions and reservations contained in the original grant of the said lands by the Crown and, in addition, to the reservation to the Crown of a right-of-way, with power to grant the same to such persons and upon such terms as to the Crown seems fitting, for the construction and operation of a power-line over that portion of the said lands within the boundaries of Plan 6021 deposited in the Land Registry Office at Nelson.
(2.1) The Union of Spiritual Communities of Christ may, in accordance with the Cremation, Interment and Funeral Services Act, inter the remains of Laura P. Verigin, John J. Verigin Jr., Barry J. Verigin, and Nina Wendy Decaire, on the lands described in the Schedule to this Act.
(3) Upon its compliance with the provisions of the Land Registry Act relating to the issue of a certificate of title, the Registrar of Titles shall issue a certificate of title to the said lands to The Union of Spiritual Communities of Christ in accordance with the provisions of this Act.
