WHEREAS James Cook, a native of Yorkshire, England, embarked on a career at sea in 1746, rose from the ranks to become a Captain in the Royal Navy and one of the world's most famous maritime explorers and navigators;

AND WHEREAS Cook in his early career participated in the charting of the St. Lawrence River and thereafter conducted detailed surveys of the coasts of Newfoundland and Labrador;

AND WHEREAS Cook was appointed by the British Admiralty to command three successive expeditions to the Pacific and Antarctic regions, which resulted in many notable discoveries and contributed to the advancement of scientific knowledge in navigation, cartography, zoology, botany, medicine and anthropology;

AND WHEREAS Cook was directed on his third voyage to seek a navigable sea route from the Pacific to the Atlantic, and having embarked on that voyage in July, 1776 aboard H.M.S. Resolution , accompanied by H.M.S. Discovery , he reached the shores of Vancouver Island in March, 1778, anchored at Nootka Sound to refit his ships, and sojourned there until April 26, 1778;

AND WHEREAS Cook's accomplishments engendered trading enterprises based at Nootka Sound which established British claim to the territory leading eventually to the creation of British Columbia and to the realization of a Canadian nation stretching from sea to sea;

AND WHEREAS it is desirable to provide for the appropriate commemoration of these events in the Province of British Columbia;

NOW, THEREFORE, HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Proclamation of Bi-Centennial year

1   The Lieutenant-Governor in Council shall order that a Proclamation be issued proclaiming 1978 as Captain Cook Bi-Centennial Year.

Commemoration committee

2   (1) The Lieutenant-Governor in Council shall select and appoint a committee to plan and administer the commemoration of the 200th anniversary of the landing of Captain James Cook at Nootka Sound.

(2) On their appointment, the members of the committee and their successors are a corporation under the name "Captain Cook Bi-centennial Committee".

(3) The members of the committee shall hold office during the pleasure of the Lieutenant-Governor in Council.

(4) The Lieutenant-Governor in Council shall select and appoint from among the members of the committee a chairman, vice-chairman and such other officers as he considers necessary.

(5) The members shall serve without remuneration but may be reimbursed for expenses necessarily incurred by them in the performance of their duties in such manner and in such amounts as the Lieutenant-Governor in Council may order, and the expenses shall be paid by the committee.

(6) The committee is an agent of Her Majesty in right of the Province.

Duties and powers

3   The committee has the duty, function and power to,

(a) make and carry out all arrangements necessary for planning and administering the commemoration of the 200th anniversary of the landing of Captain Cook at Nootka Sound,

(b) enter into agreements or arrangements with the Government of Canada, a province, state, or country, or with any person, association, or organization for the purpose of planning, administering, or celebrating the commemoration,

(c) employ persons for the purpose of this Act,

(d) receive and administer all funds, grants, gifts, revenues and other assets, real or personal, required by the committee for the purposes of this Act,

(e) make grants to any person, association, or organization to assist in the financing of projects consistent with the purpose of this Act, and

(f) do such other things as it considers appropriate in respect of the commemoration.

Records

4   The committee shall keep and preserve records of all of its proceedings.

Accounts

5   The accounts of the committee shall be audited and reported on by the Auditor General, or by another person who may be appointed by the Lieutenant-Governor in Council.

Proceedings prohibited

6   No proceeding shall be brought against a member of the committee arising from anything done or omitted in good faith in the execution of powers or duties under this Act.

Offence

7   (1) No person shall, for commercial purposes,

(a) use the words "Captain Cook Bi-Centennial Commemoration", or

(b) produce, distribute, sell, or use symbols, emblems, souvenirs and similar things relating to the commemoration

unless authorized in writing by the committee.

(2) A person who contravenes subsection (1) commits an offence and is liable to a fine of not more than $2 000.

Regulations

8   The Lieutenant-Governor in Council may make regulations.

Appropriation

9   Money required for the purposes of this Act shall until March 31, 1978 be paid out of the Consolidated Revenue Fund without any other appropriation and thereafter shall be paid out of such money as may be authorized by the Legislature.

Dissolution

10   (1) After completion of the commemorative events and when the purposes for which the committee is established have been fully carried out, the Lieutenant-Governor in Council may, when the affairs of the committee are terminated to his satisfaction,

(a) direct the disposition of all money and other assets, real or personal, vested in the committee, and

(b) order the dissolution of the committee.

(2) On the making of an order under subsection (1) (b), the powers of the committee shall be deemed to have ceased on the date named in the order, except for the purpose of completing the winding-up of the affairs of the committee and the disposition of its assets.
