Interpretation

1   In this Act

"Coast Plan Trust" means the trust agreement made as of June 15, 1973 between

(a) Regional Council Number One International Woodworkers of America, A.F.L., C.I.O., C.L.C. on behalf of Locals 1-71, 1-80, 1-85, 1-118, 1-217, 1-288, 1-357, 1-363, 1-367, 1-405, 1-417, 1-423, 1-424, 1-184, 1-206, 1-207 and 1-324,

(b) Forest Industrial Relations Limited on behalf of its client members,

(c) other employers who signify acceptance and agreement to participate and be bound by the terms of the plan, and

(d) Keith J. Bennett, Harry L. Cooper, Frederick Fieber, John E. Hall, John A. Moore and John J. Munro being the first trustees of the I.W.A.–Forest Industry Pension Plan;

"Northern Interior Plan Trust" means the trust agreement made as of September 1, 1973 between

(a) Regional Council Number One International Woodworkers of America, A.F.L., C.I.O., C.L.C. on behalf of Local 1-424,

(b) North Cariboo Forest Labour Relations Association on behalf of its client members, Northwood Timber Limited, Bulkley Valley Forest Industries Limited, Canfor Ltd. and Takla Forest Products Limited,

(c) other employers who signify acceptance and agreement to participate and be bound by the terms of the plan, and

(d) J. Holst, F. McLaughlin, T. Mogensen, D. Muirhead, J.J. Munro and W.M. Patton as the first trustees of the I.W.A.–Northern Interior Forest Pension Plan;

"Southern Interior Plan Trust" means the trust agreement made as of July 26, 1973 between

(a) Regional Council Number One International Woodworkers of America, A.F.L., C.I.O., C.L.C. on behalf of Locals 1-405, 1-417 and 1-423,

(b) Interior Forest Labour Relations Association on behalf of its client members,

(c) other employers who signify acceptance and agreement to participate and be bound by the terms of the plan, and

(d) Elie Edward Alexandre, David J. Bremner, Michael H. Davison, Barney Lukas, Clifford C. Michael, Charles Wayne Nowlin, William Francis Schumaker and T. Wyman Trineer being the first trustees of the I.W.A.–Southern Interior Forest Pension Plan;

"trustees" means the trustees appointed and holding office under the Northern Interior Plan Trust, the Southern Interior Plan Trust and the Coast Plan Trust.

Amendments validated

2   The amendments to the Northern Interior Plan Trust, the Southern Interior Plan Trust and the Coast Plan Trust made as of December 31, 1977 and described as second instruments of amendment to those trust agreements shall be conclusively deemed to have been validly made.

Merger validated

3   A merger or other act or proceeding carried out by the trustees and a document or instrument executed by the trustees in accordance with the amendments referred to in section 2 shall be conclusively deemed to have been validly done and to be valid and binding on all persons, both ascertained and unascertained having, on or after the coming into force of this Act, an interest in the pension plans and trusts established pursuant to the Coast Plan Trust, the Northern Interior Plan Trust and the Southern Interior Plan Trust, whether vested or contingent.

Commencement

4   This Act shall be deemed to have come into force on December 31, 1977 and is retroactive to the extent necessary to give it effect on and after that date.
