Disposition of False Creek property

1   (1) At the written direction of the minister, British Columbia Hydro and Power Authority shall, for the sum of $10 million, paid to British Columbia Hydro and Power Authority by British Columbia Place Ltd.,

(a) dispose of the property listed in the Schedule as items 1, 2 and 3, to British Columbia Place Ltd., and

(b) dispose of the statutory right of way listed in the Schedule as item 4, to British Columbia Transit,

in the manner and on terms and conditions specified by the minister.

(2) A direction under this section is not valid with respect to the property listed in the Schedule as item 1 or 4 until British Columbia Hydro and Power Authority receives from the trustee for the holders of the first mortgage bonds issued by the British Columbia Electric Company Limited, the trustee's consent and authorization to the disposition of that property.

Effect of disposition

2   A disposition made under this Act is valid and shall be conclusively deemed to have been made in the best interests of British Columbia Hydro and Power Authority, and shall not constitute a breach of covenant, default or event of default in relation to those bonds, or under any trust deed, bond or other instrument affecting the property disposed of.

3   No fees are payable under the Land Title Act in respect of a registration of a disposition under this Act.
