Utilities Commission Act

Direction to the British Columbia Utilities Commission
Respecting the Exemption of Independent Power Producers

Definitions

1   In this regulation:

"Act" means the Utilities Commission Act;

"Fortis" means FortisBC Inc.;

"independent power producer" means a person, or the successors or assigns of a person, who produces electricity and enters into an energy supply contract, within the meaning of section 68 of the Act, for the sale of electricity to Fortis.

Application

2   This direction is issued to the commission under section 3 of the Act.

Exemption of independent power producers

3   Within 10 days after the date this regulation comes into force, the commission must exercise its power under section 88 (3) of the Act to exempt independent power producers from Part 3, except section 22, of the Act in respect of

(a) the production of electricity and the sale of that electricity to Fortis, and

(b) the equipment, facilities, plant, projects or systems used for the production of electricity and the sale of that electricity to Fortis.
