Definitions

1   In this regulation:

"Act" means the University Endowment Land Act;

"UEL bylaw" means a bylaw enacted by the minister under section 12 (1) of the Act;

"young person" has the same meaning as in section 1 of the Youth Justice Act.

Maximum fine amounts

2   The following are the maximum amounts of fines that may be imposed under a UEL bylaw:

(a) $3 000, unless paragraph (b) applies;

(b) $1 000, if a young person is charged with an offence that is dealt with under Division 3 of Part 8 of the Community Charter.

Prescribed classes of bylaw enforcement officers

3   The following are the prescribed classes of persons who may be designated as bylaw enforcement officers for the purpose of the enforcement of a UEL bylaw:

(a) members, other than civilian members, of the Royal Canadian Mounted Police;

(b) persons

(i) who are employees, as defined in section 1 of the Public Service Act, and

(ii) whose duties include the enforcement of one or more UEL bylaws;

(c) persons

(i) who are employees of a corporation retained by the government for the purpose of the enforcement of one or more UEL bylaws, and

(ii) whose duties as employees of the corporation include the enforcement of one or more UEL bylaws.

Prescribed forms of tickets and their content

4   (1) A ticket issued for the purposes of the enforcement of a UEL bylaw must be in Form A or Form B.

(2) The certificate for service to be printed on the reverse side of the ticket must be

(a) in Form A.1 with respect to a ticket in Form A, and

(b) in Form B.1 with respect to a ticket in Form B.

(3) The instructions to be printed on the reverse side of the copy of the ticket given to the person alleged to have contravened a bylaw must be

(a) in Form A.2 with respect to a ticket in Form A, and

(b) in Form B.2 with respect to a ticket in Form B.

Prescribed form of affidavit

5   An affidavit for the purposes of section 272 (4) of the Community Charter, as that section applies in respect of the enforcement of UEL bylaws, must be in Form C.
