Northern Rockies Regional Municipality
Interim Regulation

Definition

1   In this regulation, "municipality" means the Northern Rockies Regional Municipality.

Application of and modifications to the Environmental Management Act

2   (1) In this section, "Act" means the Environmental Management Act.

(2) The definition of "district director" in section 1 (1) of the Act is modified in paragraph (c) to include a reference to a person appointed under section 33 of that Act as district director by the municipality.

(3) Sections 24 (2) and 33 to 35 of the Act apply in relation to the municipality as if the municipality were a regional district.

(4) The definition of "regional district" in section 25 (1) of the Act is modified to include the municipality within the meaning of regional district.

Application of and modifications to the Hospital District Act

3   (1) In this section, "Act" means the Hospital District Act.

(2) Section 3 (1) (c) [voting unit] of the Act does not apply in relation to the letters patent of the Northern Rockies Regional Hospital District.

(3) Despite section 8 (1) [regional hospital board] of the Act, the regional hospital district board of the Northern Rockies Regional Hospital District consists of the members of the council of the municipality.

(4) Despite section 9 [voting] of the Act, each director serving on the board of the Northern Rockies Regional Hospital District has one vote.

(5) In relation to the application of section 13 (1) [election of chair] of the Act to the Northern Rockies Regional Hospital District, that section is modified to exclude reference to "Where the directors hold office under section 8 (1),".

(6) Despite section 16 (1) [calling of meetings] of the Act, the following provisions of the Community Charter apply to the calling and conduct of meetings of the board of the Northern Rockies Regional Hospital District:

(a) Division 3 of Part 4 [Open Meetings];

(b) section 116 (2) (c) [mayor presides at council meetings];

(c) section 124 (2) (c) [minutes];

(d) section 125 (1), (3) and (4) [council meetings];

(e) section 126 [calling of special council meetings];

(f) section 128 [electronic meetings and participation by members];

(g) section 132 [authority of presiding member];

(h) section 133 [expulsion from meetings];

(i) section 282 (2) (c) [regulations relating to meeting rules].

(7) In relation to the application of section 17 (2) [cost of administering the affairs of regional hospital district] of the Act to the Northern Rockies Regional Hospital District, that section is modified

(a) to apply despite the Community Charter, and

(b) such that the reference to "relevant regional district" is read as a reference to the municipality.
