1 In this regulation:
"Act" means the Utilities Commission Act;
"energy supply contract" means the contract dated June 10, 2011 between the authority and Conifex Power Inc., assigned by Conifex Power Inc. to Conifex Power Limited Partnership, as amended.
2 The authority and Conifex Power Limited Partnership are exempt from section 71 of the Act with respect to an amendment to the energy supply contract to allow Conifex Power Limited Partnership to produce up to 50% of the electricity supplied under the energy supply contract using natural gas fuel, subject to the following:
(a) the amendment must cease to be effective on August 1, 2020;
(b) the amendment must not cause the cost of electricity purchased by the authority under the energy supply contract to increase.
