Game Farm Act

Game Farm Regulation

Interpretation

1   In this regulation:

"Act" means the Game Farm Act;

"coordinator" means the game farm coordinator appointed by the minister under section 2;

"farm" means the land in respect of which the licensee holds a licence under the Act.

Game farm coordinator

2   The minister may appoint an employee of the minister's ministry as the game farm coordinator.

Application for licence

3   (1) An application for a game farm licence must be in the form of Appendix 1.

(2) To qualify for a game farm licence, an applicant must be the lessee or registered owner of the land in respect of which the licence is being sought.

Control of game

4   A licensee must

(a) confine to the farm the game for which the game farm licence is held, or

(b) maintain custody, directly or through the agents or employees of the licensee, of any game being transported or exhibited outside of the farm.

Notification of escape, possible escape and recapture

5   (1) If game escapes from the farm or custody of a licensee and is not recaptured within 24 hours after that escape, the licensee must report the escape to an inspector within 36 hours after the discovery by the licensee of the escape.

(2) If a licensee becomes aware of information that suggests that game might have escaped from the farm or custody of the licensee, the licensee must

(a) complete an inventory of the herd of game for which the game farm licence is held within 24 hours, and

(b) report any shortages in the herd disclosed by that inventory to an inspector within 36 hours

after becoming aware of the information that suggested the possibility of an escape.

(3) A licensee must provide to the coordinator a written report of

(a) an escape to which subsection (1) applies, or

(b) a shortage to which subsection (2) applies

within 7 days after becoming aware of the escape or shortage.

Notification of recapture

6   A licensee that is required under section 5 (2) to make a report to the coordinator must provide to the coordinator a written report of the recapture of escaped game within 7 days after the recapture.

Game at large

7   (1) A licensee must recapture game that escapes from the licensee's farm within 30 days of the escape of the game to avoid application of section 76 of the Wildlife Act to that game.

(2) Despite subsection (1), section 76 of the Wildlife Act applies to escaped game if, in the opinion of the game farm coordinator, the escaped game may constitute a danger to property, the health or safety of an animal or individual or to the genetic integrity of wildlife.

Shooting of game

8   (1) Subject to subsection (2), a licensee must not shoot or authorize the shooting of the licensee's game other than

(a) to end the suffering of the animal, or

(b) if the licensee is a natural person, to provide food for the licensee and the licensee's family.

(2) The licensee, or an agent or employee of the licensee who has been authorized by the licensee to do so, may shoot the licensee's game if

(a) the game is at large,

(b) the licensee has first obtained the written permission of the minister to do so, and

(c) the game is shot in such a way as to cause its death in a quick and humane manner.

Removal of antlers

9   A licensee must not remove, or cause to be removed, precalcified antlers from game without first administering to the game a nerve blocking agent

(a) of a type,

(b) in a dosage, and

(c) in a manner

recommended by a practising member of the British Columbia Veterinary Medical Association.

Movement of game

10   A licensee whose game farm licence has been suspended must not move game in or out of the farm without the prior written approval of the minister.

Fees

11   (1) The fee

(a) for a game farm licence is $200, and

(b) for a renewal of a game farm licence is $100.

(2) Subject to the Financial Administration Act, the fee paid in respect of an application made under subsection (1) is not refundable unless the application is rejected, in which event the fee, less the sum of $25, must be repaid to the applicant.
