Oil and Gas Activities Act

Exemption Regulation

Definitions

1   In this regulation:

"Act" means the Oil and Gas Activities Act;

"former Act" has the same meaning as in section 117 (1) of the Act.

Exemption

2   (1) Subject to subsection (2), a person is exempt from the requirement under section 21 (a) (i) of the Act to hold a pipeline permit in respect of a pipeline if

(a) the person holds, in respect of the pipeline, a certificate issued under section 2 (2) of the former Act and in effect immediately before the repeal of the former Act, and

(b) the person does not hold a pipeline permit in respect of the pipeline.

(2) An exemption under subsection (1) is subject to the condition that a person in the class of persons described in that subsection complies with the Act and regulations under the Act as if each reference to "permit holder" and "pipeline permit holder" in the Act and the regulations is a reference to the class of persons described in that subsection.
