Private Post-Secondary Education Regulation

 Exclusions from the definition of post-secondary education

1  Training or instruction is designated not to be post-secondary education for the purposes of the Private Post-Secondary Education Act if it is

(a) provided at no fee or charge to be paid by or on behalf of the students,

(b) provided by an employer solely for its employees,

(c) Repealed. [B.C. Reg. 464/95, s. 1.]

(d) ancillary to attendance at a conference,

(e) purchased from a vendor or lessor of a product if the training is included in the purchase agreement of the product,

(f) provided to inmates of correctional institutions, or

(g) provided by a council or regional district, as defined in the Municipal Act.

 Exclusions for Community Skills Centres in Schedule 1

1.1  (1)  Training or instruction is designated not to be post-secondary education for the purposes of the Private Post-Secondary Education Act if it is provided by a Community Skills Centre listed in Schedule 1.

(2)  This section is repealed March 31, 2001.

 Exclusions for Community Skills Centres in Schedule 2

1.2  (1)  Training or instruction is designated not to be post-secondary education for the purposes of the Private Post-Secondary Education Act if it is provided by a Community Skills Centre listed in Schedule 2.

(2)  This section is repealed September 30, 2000.

 Registration information

2  On application for registration or renewal of registration, institutions must provide the following information in the format required by the commission:

(a) legal and operating names of institution;

(b) addresses of institution;

(c) name and location of any other business carried on with or associated with the institution, at this or any other location;

(d) names of principals;

(e) name of chief operating officer;

(f) name of chief education officer;

(g) institutional offerings and duration for each program;

(h) minimum qualifications of instructors for each program;

(j) maximum amount of unearned fee income that potentially could be received by the institution during the coming year of registration;

(k) maximum planned enrolment per program;

(l) Repealed. [B.C. Reg. 464/95, s. 2 (a).]

(m) registration number of current business licence;

(n) Workers' Compensation Board number;

(o) Repealed. [B.C. Reg. 464/95, s. 2 (a).]

(p) statutory declaration;

(q) authorized signatory;

(r) Repealed. [B.C. Reg. 464/95, s. 2 (a).]

(s) legal status of institution (sole proprietor, partnership, society, corporation);

(t) total student enrolment for the institution's immediately preceding instructional year;

(u) sources of funding from local, provincial, or federal governments, if applicable.

 Re-registration fees

3  (1)  Subject to subsections (2), (3) and (4), the prescribed fee for the purposes of section 6 (1) (d) of the Private Post-Secondary Education Act is

(a) $850 for the main branch of an institution, and

(b) $450 for each additional branch of the institution not covered by paragraph (a).

(2)  Despite subsection (1), an institution may apply to the executive director to pay a fee of $115 under the following circumstances:

(a) Repealed. [B.C. Reg. 215/98, s. 1.]

(b) its annual gross revenue from the provision of post-secondary education is less than $20 000;

(c) it does not accept prepaid fees from or on behalf of its post-secondary education students.

(3)  A fee under subsections (1) and (2) is increased by 50% for an application for renewal of registration if the applicant fails to

(a) complete and submit the application and all renewal documentation, and

(b) pay the fee established under subsections (1) and (2)

at least 60 days before the current registration ends.

(4)  A fee under subsection (1) and (2) is increased by $25 per business day for a renewal of registration if the applicant fails to

(a) complete and submit the application and all renewal documentation, or

(b) pay the fee established under subsections (1) and (2)

after the current registration ends.

 New registration fees

3.1  (1)  Subject to subsection (2), the prescribed fee for the purposes of section 6 (1) (d) of the Private Post-Secondary Education Act is

(a) $850 for the main branch of an institution, and

(b) $450 for each additional branch of the institution not covered by paragraph (a).

 Requirements for accreditation

4  After actively operating as a registered institution for a period of one year or more, an institution may apply to the executive director for accreditation pursuant to the provisions of the Act and regulations.

 Accreditation information

5  On application for accreditation or renewal of accreditation, institutions must provide the following information in the format required by the commission:

(a) business name of the institution;

(b) legal name of the institution;

(c) mailing address of the institution;

(d) street address of the institution (where different from the mailing address);

(e) current Private Post-Secondary Education Commission registration number;

(f) name, title and phone number of the person completing the application for accreditation;

(g) name, title and phone number of the contact person for accreditation (where different from the person completing the application for accreditation);

(h) authorized signature of the person completing the application for accreditation;

(i) an accountant's certificate, if requested by the commission.

 Accreditation fees

6  The prescribed fee for the purposes of section 12 (1) (b) of the Private Post-Secondary Education Act is

(a) $250 for the main branch of an institution, and

(b) $125 for each additional branch of the institution.
