Section 175 (2) of the Community Charter does not apply

1   Section 175 (2) of the Community Charter does not apply to an agreement under which a municipality or regional district acquires an interest or right in or with respect to land if the liability in relation to which that provision would otherwise apply is one or both of the following:

(a) an obligation that the municipality or regional district maintain the land;

(b) an obligation that the municipality or regional district indemnify the grantor of the interest or right being acquired by the municipality or regional district, as the case may be.
