Community Care Facility Exemption Regulation

 Exemption of motor vehicles

1  A motor vehicle is exempt from the application of the Motor Carrier Act if

(a) the Motor Carrier Act would otherwise apply to it because it is used by a community care facility as defined in section 1 of the Community Care Facility Act, and

(b) the motor vehicle is used in no other way to which the Motor Carrier Act applies except by the community care facility.

 Exemption of persons

2  A person is exempt from the application of the Motor Carrier Act if the Motor Carrier Act would otherwise apply to the person solely because of a motor vehicle described in section 1, assuming section 1 did not exempt the motor vehicle from the Motor Carrier Act.

 Repeal

3  This regulation is repealed on the day the Community Care and Assisted Living Act, S.B.C. 2002, c. 75, comes into force.
