Schedule

65 Section 31 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended

(a) by renumbering the section as section 31 (1),

(b) by repealing subsection (1) (d), (e), (i), (j) and (k), and

(c) by adding the following subsection:

(2) The Act does not apply to an employee who is authorized under the Health Professions and Occupations Act to practise, and is carrying on the practice of, any of the following designated health professions:

(a) medicine, if the employee is authorized to use the title "medical practitioner";

(b) podiatric medicine;

(c) dentistry, if the employee is authorized to use the title "dentist";

(d) optometry;

(e) naturopathic medicine or chiropractic.

66 Section 33 is amended

(a) by renumbering the section as section 33 (1),

(b) by repealing subsection (1) (a) and (b) and substituting the following:

(a) a student who is in training

(i) in a recognized nursing program to practise the designated health profession of nursing, practical nursing or psychiatric nursing, or

(ii) at a hospital to practise the designated health profession of practical nursing; , and

(c) by adding the following subsection:

(2) For the purposes of this section:

"designated health profession" and "eligibility standard" have the same meaning as in the Health Professions and Occupations Act;

"hospital" has the same meaning as in section 1 of the Hospital Act;

"nursing regulator" means the regulator that is responsible, under the Health Professions and Occupations Act, for governing the designated health profession of nursing, practical nursing or psychiatric nursing;

"recognized nursing program" means an academic or technical program that is recognized by the nursing regulator as meeting an eligibility standard that must be met to practise the designated health profession of nursing, practical nursing or psychiatric nursing.
