Interpretation

1  In this regulation:

"ASME" means the American Society of Mechanical Engineers;

"audit" has the same meaning as defined in the code;

"code" means the ASME Boiler and Pressure Vessel Code as amended from time to time;

"normal working hours" means the hours between 8:00 a.m. and 4:30 p.m. Monday to Friday inclusive, excluding statutory holidays;

"overtime inspection" means an inspection outside normal working hours if the person requesting it has submitted the request in writing to the director, has indicated acceptance of overtime charges and has received the prior approval of the director to the overtime;

"survey" has the same meaning as defined in the code;

"vessel" means a boiler, pressure vessel, pressure piping system, fitting, plant or refrigeration equipment.

 Payment of fees

2  (1)  Unless otherwise specified in this regulation, fees under the Power Engineers and Boiler and Pressure Vessel Safety Act are due on the date specified in the invoice and must be paid by the owner of the vessel or the person being examined for certification, as the case may be.

(2)  If the fee is not received by the branch within 30 days after its due date, the director may, without a hearing, suspend the debtor's licence, permit or certificate to which the fee relates.

 Hourly rates

3  The hourly rates set out in Schedule A apply to

(a) re-inspections under section 6 of the Act,

(b) installation or alteration inspections,

(c) an inspection of the construction of a pressure containment component including the preparation by an inspecting power engineer of documents required to comply with the code or to comply with a request by the manufacturer or owner of the component,

(d) welding layout and field activities,

(e) surveys,

(f) audits,

(g) an inspection for which no other fee is provided,

(h) a disconnection, reconnection, lockout and removal of a lockout when they are required as a result of a suspension of a licence, permit or certificate, and the fee must be paid before the reconnection,

(i) final inspection of a new or relocated unit prior to being placed in service, and

(j) preparation and issuance of ad hoc reports.

 Overtime inspections

4  The fee for an overtime inspection, payable by the owner or contractor who requested the overtime, is the normal fee prescribed for the inspection plus an amount equal to the hourly rate times the hours of overtime.

 Design inspection

5  The fee for a design inspection under section 14 of the Act,

(a) if the design specifications of the vessel are submitted to the director in sufficient detail, including supporting calculations, to enable the director to verify materials, design, construction and installation for compliance with applicable standards, is set out in Schedule B,

(b) if the design specifications are not submitted in accordance with paragraph (a), is the hourly rate set out in Schedule A, and

(c) if pressure welding procedures are submitted, is the fee under paragraph (a) or (b), plus the fee set out in Schedule I for ASME Welding Procedure Registration for each procedure specified in the code, except for welding layout and field activities, for which the hourly rates in Schedule A apply.

 Vessel construction inspection

6  The fee for a vessel construction inspection under section 4 of the Act is set out in Schedule C.

 Installation or alteration inspection

7  The fee for an installation or alteration inspection under section 4 of the Act is set out in Schedule A.

 Installation or alteration permit

8  The fee for an installation or alteration permit under section 14 of the Act is set out in Schedule D and is payable by the owner or contractor at the time of application for the permit.

 Boilers — annual fees

9  (1)  If a boiler inspection is not a design, construction, installation or alteration inspection and is scheduled by the director to take place once every 3 years, the fee for the inspection under section 4 of the Act is a total of 3 annual payments.

(2)  Each payment under subsection (1) is in the amount set out in Schedule E, payable as follows:

(a) the first payment is due after successful completion of the installation inspection and the commencement of boiler operation;

(b) subsequent annual payments are due on the anniversary date of the commencement of boiler operation.

 Digesters — annual fee

10  The fee for an inspection of a digester, if the inspection is scheduled by the director to take place once every 2 years, is the total of 2 annual payments each of which is payable on the anniversary date of the first installation inspection and each of which is in the amount set out in Schedule F.

 Pressure vessels — annual fee

11  (1)  In this section:

"regular service pressure vessel" is one to which subsection (2) (a) applies;

"designated service pressure vessel" is one to which subsection (2) (b) applies;

"special service pressure vessel" is one to which subsection (2) (c) applies.

(2)  In the case of a pressure vessel that is not referred to in subsection (4) (d) or (e), the director may, from time to time, determine whether the pressure vessel requires inspections

(a) approximately once every 5 years,

(b) approximately once every 3 years, or

(c) approximately once every 2 years.

(3)  In making a determination under subsection (2) the director must consider the condition of the pressure vessel, its load cycling frequency, the environment in which it operates, the likelihood of its corrosion or physical damage and any other factor that reasonably relates to the safe operating life of the pressure vessel.

(4)  The fee payable for a pressure vessel inspection under section 4 of the Act, if the inspection is not a design, construction, installation or alteration inspection or an inspection under section 8 or 9, and if the pressure vessel is

(a) a regular service pressure vessel, is payable in annual installments in the amount set out in Schedule G-1,

(b) a designated service pressure vessel, is payable in annual installments in the amount set out in Schedule G-2,

(c) a special service pressure vessel, is payable in annual installments in the amount set out in Schedule G-3,

(d) an LPG service pressure vessel, is payable in annual installments in the amount set out in Schedule G-4,

(e) a dryer roll, is the amount set out in Schedule G-5, and

(f) a refrigeration plant, is the amount set out in Schedule G-6.

 Contractor fees

12  The fee for a licence or renewal of licence for a contractor referred to in section 14 (1) (d) (i) of the Act, or for the registration or renewal of registration of a person referred to in section 14 (1) (d) (ii) of the Act, is set out in Schedule J.

13  The fees for evaluation of credentials, examinations and the issuance of interim or final certificates of competency are set out in Schedule H for all classes or categories of certificates.
