Interpretation

1   In this regulation, "Act" means the Offence Act.

Ticket and summons

2   (1) A violation ticket, other than a violation ticket that is an eTicket or a violation ticket issued under a treaty first nation law, must be in Form H, Form K, Form L, Form O, Form S, Form T or Form U.

(1.1) A printout or display of an eTicket must be in Form Q or Form R.

(2) Except in the case of a violation ticket issued under a treaty first nation law, the instructions to be printed beside or on the reverse side of the copy of the violation ticket given to the person alleged to have contravened an enactment must be as follows:

(a) Repealed. [B.C. Reg. 179/2023, App. 2, s. 1 (c).]

(b) in Form H.1 with respect to a violation ticket in Form H;

(c) Repealed. [B.C. Reg. 133/2019, App. 2, s. 2.]

(d) in Form L.1 with respect to a violation ticket in Form K or Form L;

(d.1) Repealed. [B.C. Reg. 133/2019, App. 2, s. 2.]

(e) in Form O.1 with respect to a violation ticket in Form O;

(f) Repealed. [B.C. Reg. 179/2023, App. 2, s. 1 (c).]

(g) in Form Q.1 with respect to the printout of an eTicket in Form Q;

(h) in Form R.1 with respect to the printout of an eTicket in Form R;

(i) in Form S.1 with respect to a violation ticket in Form S;

(j) in Form U.1 with respect to a violation ticket in Form T or Form U.

(3) The certificate of service to be printed beside or on the reverse side of the violation ticket, other than a violation ticket that is an eTicket or a violation ticket issued under a treaty first nation law, sent to the Insurance Corporation of British Columbia must be as follows:

(a) Repealed. [B.C. Reg. 179/2023, App. 2, s. 1 (d).]

(b) in Form H.2 with respect to a violation ticket in Form H;

(c) in Form L.2 with respect to a violation ticket in Form K or Form L;

(d) in Form O.2 with respect to a violation ticket in Form O;

(e) in Form S.2 with respect to a violation ticket in Form S;

(f) in Form U.2 with respect to a violation ticket in Form T or Form U.

(3.1) The printout or display of an eCertificate of service must be in Form P.2.

(4) A summons and the certificate of service of a person serving the summons must be in Form B.

Warrants

3   A warrant issued under section 36 (b) of the Act must be in Form C.

Promise to appear

4   A promise to appear and the certificate of service of a person serving a promise to appear must be in Form D.

Appearance notice

5   An appearance notice and the certificate of service of a person serving an appearance notice must be in Form E.

Affidavits

6   (1) Subject to subsection (1.1), an affidavit under section 15 (10) of the Act must be in Form F.

(1.1) In the case of a violation ticket issued under a treaty first nation law, an affidavit under section 15 (10) of the Act must be in Form F.1.

(2) Subject to subsection (2.1), an affidavit under section 16 (2) of the Act must be in Form G.

(2.1) In the case of a violation ticket issued under a treaty first nation law, an affidavit under section 16 (2) of the Act must be in Form G.1.

(3) An affidavit under section 16 (3) of the Act must be in Form J.

Disputing fine amount in writing

7   (1) In this section:

"business day" means a day other than a Saturday or a holiday;

"provincial electronic credential" means

(a) a BC services card electronic credential for online services, or

(b) another electronic credential for online services,

that is issued under section 69.2 of the Freedom of Information and Protection of Privacy Act by a provincial identity information services provider to an individual.

(2) A statement and written reasons under section 15.4 (1) of the Act

(a) must be in Form M, and

(b) if provided under section 15.4 (2) (d) of the Act, the statement and written reasons must be provided 5 or more business days before the date scheduled for the hearing of the dispute and by any of the following methods:

(i) delivery to the address set out in Form M;

(ii) delivery to a Provincial Court registry;

(iii) delivery by email to Courts.TCO@gov.bc.ca;

(iv) delivery by facsimile to 604-660-4868;

(v) if all conditions set out in subsection (4) of this section are met, by online submission at tickets.gov.bc.ca.

(3) A statement and written reasons under section 15.4 (3) of the Act

(a) must be in Form M, and

(b) must be provided 5 or more business days before the date scheduled for the hearing of the dispute and by any of the following methods:

(i) delivery to the address set out in Form M;

(ii) delivery to a Provincial Court registry;

(iii) delivery by email to Courts.TCO@gov.bc.ca;

(iv) delivery by facsimile to 604-660-4868;

(v) if all conditions set out in subsection (4) of this section are met, by online submission at tickets.gov.bc.ca.

(c) Repealed. [B.C. Reg. 171/2024, s. 1 (b).]

(4) The conditions referred to in subsections (2) (b) (v) and (3) (b) (v) are as follows:

(a) the notice of dispute was provided online;

(b) the person providing the statement and written reasons is the person to whom the violation ticket was issued and is an individual who

(i) has a provincial electronic credential, or

(ii) obtains a provincial electronic credential at the time of providing the statement and written reasons.

Certificates of evidence

8   A certificate of evidence under section 15.3 of the Act must be

(a) in Form N.1 for an offence under section 140 of the Motor Vehicle Act (speeding in a construction zone),

(b) in Form N.2 for an offence under section 146 (1) of the Motor Vehicle Act (speeding in a municipality),

(c) in Form N.3 for an offence under section 146 (1) of the Motor Vehicle Act (speeding outside a municipality),

(d) in Form N.4 or N.4.1, as applicable, for an offence under section 146 (3) of the Motor Vehicle Act (speeding against a highway sign),

(e) in Form N.5 for an offence under section 146 (7) of the Motor Vehicle Act (speeding against a municipal sign),

(f) in Form N.6 for an offence under section 147 (1) of the Motor Vehicle Act (speeding in a school zone), or

(g) in Form N.7 for an offence under section 147 (2) of the Motor Vehicle Act (speeding in a playground zone).
