Access to Pharmanet Patient Record Information Regulation

 Definitions

1  In this regulation:

"access" means access to patient record information on the PharmaNet system for the purpose of providing therapeutic treatment or care to patients;

"designated location" means any of the following:

(a) a hospital, as defined in section 1 of the Hospital Act, other than a hospital or that part of a hospital that is a designated facility referred to in paragraph (c);

(b) a medical practice;

(c) a designated facility, as defined in the Mental Health Act;

"medical practice" means any premises in British Columbia where a medical practitioner ordinarily practises medicine.

 Designated persons

2  Subject to section 3, the following persons are permitted to have access:

(a) a medical practitioner;

(b) a person authorized to practise in British Columbia as a

(i)  licensed practical nurse,

(ii)  registered nurse, or

(iii)  registered psychiatric nurse;

(c) a person authorized by a medical practitioner to have access

(i)  under the direct supervision of the medical practitioner, and

(ii)  in the course of carrying out the person's employment or other duties in a designated location.

 Requirements, restrictions and conditions for access

3  A person designated under section 2 is permitted to have access only

(a) if the purpose and manner of access is consistent with the standards set out in the Ministry of Health Services' publication "PharmaNet Professional and Software Compliance Standards", as amended from time to time, and

(b) from a designated location.
