1 In this regulation:
"Act" means the Community Charter;
"municipality" means the Corporation of the Village of Montrose;
"wells" means the two wells outside the municipality that, on the date this regulation is deposited, are used in the water supply system of the municipality.
2 The municipality may expropriate, in accordance with the Expropriation Act, real property or works outside the municipality or an interest in them, as is necessary for the municipality to do one or more of the following in relation to the wells:
(a) floodproof the wells in accordance with requirements under the Drinking Water Protection Act or the Water Sustainability Act;
(b) secure the wells to prevent access by an unauthorized person;
(c) secure the wells to prevent tampering with or damage to the wells or contamination of water in the wells.

3 Without limiting section 2 and whether or not the municipality expropriates in accordance with section 2, the municipality may, if it is necessary to do one or more of the things listed in section 2 (a) to (c), exercise its authority under section 32 of the Act in relation to property outside the municipality.
