Commercial Liens Regulation

Direction of seizure — prescribed information

1   For the purposes of section 32 (4) [seizure by bailiff] of the Act, the following information is prescribed to be included in a direction of seizure:

(a) the name of the bailiff;

(b) the name of the lien holder;

(c) the name of the person who took possession of the goods from the lien holder;

(d) the date on which the lien holder signed the direction of seizure;

(e) the location of the goods, if known by the lien holder.

Bailee's undertaking — prescribed information

2   (1) In this section, "base registration" has the same meaning as in the Personal Property Security Regulation.

(2) For the purposes of section 34 (1) (c) [bailiff may appoint bailee], the following information is prescribed to be included in the undertaking:

(a) the name of the bailiff;

(b) the name of the person who is to be designated as the bailee;

(c) the date on which the person who is to be designated as the bailee signs the undertaking;

(d) a description of the goods to be held by the person who is to be designated as the bailee;

(e) the address of the location, or, if no address is available, a description of the location where the person who is to be designated as the bailee will hold the goods;

(f) the base registration number in relation to the lien.
