Real Estate Council's Hearing Costs Regulation
Costs recoverable by the council
2 The costs that the council may order the licensee or former licensee to pay, for a hearing under section 31 (3) of the Act in which the council finds that the licensee or former licensee has done anything referred to in section 31 (1) (a) to (c) of the Act, are limited to the following:
(a) administrative costs for each full or partial day of hearing in the amount of
(i) $825 for a hearing before 3 members of the council, or
(ii) $1 100 for a hearing before 4 or more members of the council;
(b) costs for reasonably necessary legal services
(i) of $100 per hour for each employed lawyer of the council or the government, and
(ii) up to but not exceeding $200 per hour for a lawyer other than an employed lawyer of the council or the government;
(c) fees paid to a witness other than an expert witness of $25 for each full or partial day of the hearing at which the witness is in attendance at the request of the council or the hearing committee of the council;
(d) fees paid to an expert witness up to but not exceeding $200 per hour for time spent by the witness in attending at the hearing at the request of the council or the hearing committee of the council;
(e) a witness' reasonable travel and reasonable living costs;
(f) costs for reasonably necessary audit services of $75 per hour, in relation to the matters that give rise to the hearing;
(g) disbursements properly incurred in connection with the provision of legal services to the council or hearing committee of council;
(h) other costs, reasonably incurred, arising out of the hearing.
