Community Charter

Buildings and Other Structures Bylaws Regulation

Definitions

1   In this regulation:

"Act" means the Community Charter;

"Code" means the British Columbia Building Code Regulation, B.C. Reg. 216/2006.

Council's exercise of authority respecting buildings and other structures

2   (1) For the purposes of section 9 (4) (a) of the Act, a council may adopt a bylaw that establishes standards for the construction, alteration, repair or demolition of buildings or structures

(a) that are listed in sentence 1.1.1.1. (2) of Division A of the Code, or

(b) that are not "buildings" as defined in the Code.

(2) For the purposes of section 9 (4) (a) and (b) of the Act, a council may adopt a bylaw that establishes standards for the construction, alteration, repair or demolition of a building or structure not referred to in subsection (1), subject to the restrictions that the bylaw must not

(a) establish standards that are additional to or different from the standards established by the Code,

(b) extend or change the application or scope of the Code as specified in articles 1.3.2.1, 1.3.3.1., 1.3.3.2. or 1.3.3.3. of Division A or subsection 2.2.7. of Division C of the Code, or

(c) change the form of a letter that is set out in a schedule to subsection 2.2.7. of Division C of the Code.
