(2)  For the purposes of this Part "employee" includes a Provincial judge, a coroner or other person appointed to a position or office to which is attached a salary payable by the government.

5  If a contract or contracts made under this Part require money to be provided or paid by the Minister of Finance and Corporate Relations or otherwise on behalf of the government as employer under this Part, it must be provided or paid by the Minister of Finance and Corporate Relations

  Section 6 (1) BEFORE amended by 2003-54-27,Sch A, effective April 1, 2004 (BC Reg 11/2004).

6  (1)  The Minister of Finance and Corporate Relations may establish one or more funds to provide for any financial obligations assumed by the government under this Part.

(2)  The Long Term Disability Fund is continued and is deemed to be established under this section.

  Section 6 (5) BEFORE amended by 2007-1-19(b), effective March 31, 2007.

(5)  A fund established under this section is a trust fund for purposes of the Financial Administration Act.

  Section 6 (2.1) was added by 2014-4-3, effective March 24, 2014.

  Section 6 (2) and (2.1) BEFORE repealed by 2016-3-13(a), effective April 1, 2017.

(2) The Long Term Disability Fund is continued, is deemed to be established under this section and is to be held by the government in trust.

(2.1) The Minister of Finance may make payments from the consolidated revenue fund to address in whole or in part any decrease in the actuarial value of the Long Term Disability Fund.

  Section 6 (6) was added by 2016-3-13(b), effective April 1, 2017.

  Section 6.1 was enacted by 2016-3-14, effective April 1, 2017.

  Section 9 definition of "contributor" BEFORE amended by 2003-62-28(a), effective January 1, 2004 (BC Reg 484/2003).

"contributor" means an employee or pensioner who avails himself or herself of the coverage afforded by this Part and whose premium payments are in good standing;

  Section 9 definition of "pensioner" BEFORE repealed by 2003-62-28(b), effective January 1, 2004 (BC Reg 484/2003).

"pensioner" means

(a) a person who is receiving a pension under the Public Service Pension Plan continued under the Public Sector Pension Plans Act,

(b) a person receiving a retiring allowance paid from the consolidated revenue fund, or

(c) a former employee or his or her surviving dependant or dependants receiving a superannuation allowance under the superannuation plan applicable to the former employee.

(a) in respect of an employee defined in paragraph (a), (c) or (d) of the definition of employee, the Minister of Finance and Corporate Relations,

"contributor" means an employee who avails himself or herself of the coverage afforded by this Part and whose premium payments are in good standing;

(b) a person who receives remuneration for services rendered to an employer within the meaning of the pension plan rules made under the Public Service Pension Plan, continued under the Public Sector Pension Plans Act, and who, with the consent of that employer, elects to have this Part apply to him or her;

(c) every employee or pensioner who elects to have this Part made applicable to him or her.

(c) every employee who elects to have this Part made applicable to him or her.

  Section 11 (1) (b) BEFORE amended by 2003-62-30(a), effective January 1, 2004 (BC Reg 484/2003).

(b) despite the Public Service Pension Plan continued under the Public Sector Pension Plans Act, the pension payable to a pensioner to whom this Part applies;

(3)  The payments made under subsections (1) (a) and (b) and (2) entitle the employee or pensioner to the benefits of this Part in respect of medical and other related expenses incurred during the next succeeding calendar month only.

(3)  The payments made under subsections (1) (a) and (b) and (2) entitle the employee to the benefits of this Part in respect of medical and other related expenses incurred during the next succeeding calendar month only.

(c) the sum payable under section 2 of the Legislative Assembly Allowances and Pension Act to a member of the Legislative Assembly to whom this Part applies.

  Section 12 (1) (a) BEFORE amended by 2003-62-30, effective January 1, 2004 (BC Reg 484/2003).

(a) enter an agreement or contract with any person in respect of a plan of insurance or coverage for employees or pensioners, and their dependants, for medical and other related expenses incurred by the employees and pensioners, and their dependants, to whom this Part applies, or

(2)  Under a plan authorized by the Lieutenant Governor in Council under subsection (1), the employer must contribute a sum not less than the monthly or annual premiums authorized to be paid by the employees and pensioners under section 11.

(3)  The employer of a person whose salary or wage is not paid from public money within the meaning of the Financial Administration Act must reimburse the Minister of Finance and Corporate Relations in respect of the contributions required to be made under subsection (2) for that person.

16  All salaries and other expenses necessarily incurred in the administration of this Part, together with the payments required by the Minister of Finance and Corporate Relations under section 12 (2), must be charged to the legislative appropriation made for the purpose.

(l) defining the notice to be given by an employee or pensioner who desires to be excluded from the provisions of this Part, and determining the circumstances under which contributions may be discontinued or refunds made;
