University Endowment Land Park Act

[RSBC 1996] CHAPTER 470

 Definition

1  In this Act, "University Endowment Land" has the same meaning as in the University Endowment Land Act and includes the improvements on that land.

 Authority to transfer land and conditions of transfer

2  The Lieutenant Governor in Council may authorize the minister responsible for Crown Lands to transfer to the Greater Vancouver Regional District a specified part of the University Endowment Land by free Crown grant, subject to the following:

(a) the exceptions and reservations referred to in section 50 (1) of the Land Act except those referred to in paragraph (a) (ii) and (iv) of that section;

(b) the land and improvements transferred by the grant must be used only for park purposes and for other uses necessarily incidental to their use for park purposes;

(c) the Greater Vancouver Regional District must not transfer the land and improvements transferred by the grant unless it has first obtained the approval of the Lieutenant Governor in Council;

(d) any other conditions specified by the Lieutenant Governor in Council.

 Ecological reserve preserved on transfer

3  (1)  Despite section 5 of the Ecological Reserve Act all or part of an ecological reserve under that Act that is located within the University Endowment Land may be transferred to the Greater Vancouver Regional District by a Crown grant under section 2 of this Act.

(2)  An ecological reserve that is transferred to the Greater Vancouver Regional District under this section

(a) remains subject to, and

(b) must be administered by the Greater Vancouver Regional District in accordance with

the Ecological Reserve Act and regulations under that Act.

(3)  For the purposes of subsection (2) (b), the Greater Vancouver Regional District must appoint an administrator for the ecological reserve who has, on appointment, the authority of a person given responsibility as an administrator of ecological reserves under the Ecological Reserve Act.
