Definitions

1 In this Act:

"council" means the Interim Governing Council of the university appointed under section 3;

"faculty member" has the same meaning as in the University Act;

"university" means the University of Northern British Columbia.

University continued

2 The corporation known as the University of Northern British Columbia is continued.

Interim Governing Council

3 (1) The Interim Governing Council of the university is continued and consists of members appointed by the Lieutenant Governor in Council on the following basis:

(a) a person to be chair;

(b) the persons the Lieutenant Governor in Council considers appropriate who are university professionals that the Lieutenant Governor in Council considers have experience at a senior level;

(c) the persons the Lieutenant Governor in Council considers appropriate who reside in northern communities located within the regions established under the College and Institute Act for the College of New Caledonia, the Northern Lights College and the Northwest Community College;

(d) the persons the Lieutenant Governor in Council considers appropriate who reside within the boundaries of the Cariboo Regional District;

(e) the persons the Lieutenant Governor in Council considers appropriate who the Lieutenant Governor in Council considers to be representative of the aboriginal communities.

(2) The chair and members serve during pleasure for a term specified by the Lieutenant Governor in Council.

(3) Unless excused by resolution of the council, a person who does not attend at least half of the council's regular meetings in any year is deemed to have vacated his or her position.

(4) On being appointed, the president is a member of the council for as long as he or she holds that office.

(5) On being elected, the chancellor is a member of the council for as long as he or she holds that office.

Powers and duties of council

4 The council has the duties and may exercise the powers of the board of governors and senate of a university under the University Act.

Dissolution of council

5 On a date to be set by regulation of the Lieutenant Governor in Council,

(a) the council is dissolved, and

(b) the appointment of each person to the council is rescinded.

Powers on dissolution of council

6 Once a date has been set under section 5,

(a) the Lieutenant Governor in Council may make appointments to the board of governors and the senate, and

(b) the council may arrange for elections to the board of governors and the senate

as provided for in Parts 6 and 7 of the University Act, to take effect on that date.

Convocation

7 (1) The convocation of the university is continued.

(2) The convocation of the university is composed of

(a) the chancellor, who is to be the chair,

(b) the president,

(c) on and after the date set under section 5, the members of the senate,

(d) all faculty members,

(e) all persons who are graduates of the university, and

(f) all persons whose names are added to the roll of the convocation by the senate.

(3) In addition to the persons referred to in subsection (2), the convocation is composed of every adult who,

(a) at the time of applying, resides within

(i) a region established under the College and Institute Act for the College of New Caledonia, the Northern Lights College or the Northwest Community College, or

(ii) the Cariboo Regional District,

(b) holds a degree from a Canadian university or a degree from a university in another country that the chair of the council accepts, and

(c) applies for membership in the convocation by a date determined by the chair of the council and supplies proof of his or her degree.

(4) Twenty members of a convocation constitute a quorum for the transaction of business.

(5) Sections 6 to 10 of the University Act apply.

Chancellor

8 (1) There is to be a chancellor of the university.

(2) Part 5 of the University Act applies.

Board of governors

9 (1) On and after the date set under section 5, there is to be a board of governors.

(2) The board is to be composed of 15 members, as follows:

(a) the chancellor;

(b) the president;

(c) 2 faculty members elected by the faculty members;

(d) 5 persons appointed by the Lieutenant Governor in Council as follows:

(i) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the College of New Caledonia;

(ii) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the Northern Lights College;

(iii) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the Northwest Community College;

(iv) one who, at the time of appointment, is resident in the Cariboo Regional District;

(v) one who the Lieutenant Governor in Council considers to be representative of the aboriginal communities;

(e) 3 persons appointed by the Lieutenant Governor in Council;

(f) 2 full time students elected from all students who are members of the undergraduate student society or the graduate student society;

(g) one person elected by and from the full time employees of the university who are not faculty members.

(3) Sections 20 to 34 of the University Act apply.

Budgets — minister's approval

10 Until the university commences instruction and for 3 full fiscal years after the year in which it commences, the council or the board of governors, as the case may be,

(a) must submit its budget for approval to the minister, and

(b) must not, without first receiving the minister's approval, exceed the expenditures provided for in the budget.

Government grants to the university

11 If money has been appropriated for grants to universities for operating expenses, the minister must ensure that the grant made to the University of Northern British Columbia is equal to an amount that is determined by taking the average grant per full time equivalent student to the universities referred to in the University Act, for comparable programs, multiplying it by not more than 1.35 and multiplying the resulting product by the number of full time equivalent students on which the minister's budget for the University of Northern British Columbia is established for the fiscal year to which the grant relates.

Senate

12 (1) On and after the date set under section 5, there is to be a senate for the university.

(2) The senate is to be composed of the following members:

(a) the chancellor;

(b) the president, who is to be the chair;

(c) 2 senior academic administrators appointed by the president;

(d) 4 full time students elected by the students;

(e) 4 persons appointed by the Lieutenant Governor in Council as follows:

(i) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the College of New Caledonia;

(ii) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the Northern Lights College;

(iii) one who, at the time of appointment, is resident in the region established under the College and Institute Act for the Northwest Community College;

(iv) one who the Lieutenant Governor in Council considers to be representative of the aboriginal communities;

(f) 8 faculty members,

(i) 2 of whom are to be elected by faculty members in arts and science, from among their number,

(ii) 2 of whom are to be elected by faculty members in faculties educating professionals, from among their number, and

(iii) 4 of whom are to be elected at large by all faculty members.

(3) The term of office of a member of the senate is

(a) one year for a member elected under subsection (2) (d), and

(b) 3 years for all other members,

and after that until the successor is appointed or elected, as the case may be.

(4) Members of the senate who remain eligible under subsection (2) may be reappointed or re-elected in the manner provided under that subsection for further terms.

(5) Sections 36 (4) to (7), 37 and 38 of the University Act apply.

Parts 8 and 9 of University Act

13 Parts 8 and 9 of the University Act apply.

Powers and duties of the university

14 (1) Part 10 of the University Act applies.

(2) Despite subsection (1), the university, in exercising its powers under that Part, must comply with the development plan approved by the minister under section 15.

Development plans

15 The council or the board of governors, as the case may be, must

(a) submit to the minister for approval a 3 year plan that includes special emphasis on northern British Columbia and that is developed according to the guidelines and procedures established by the minister, and

(b) update the plan every 3 years.

Parts 11, 12 and 13 of University Act

16 Parts 11, 12 and 13 of the University Act apply.

Repeal of University of Northern British Columbia Act

17 (1) This Act is repealed on a date to be set by regulation of the Lieutenant Governor in Council.

(2) On being satisfied that for 2 consecutive years the university has had an enrollment of 2 500 full time equivalent students, the Lieutenant Governor in Council must promptly set a date under subsection (1).

(3) On the repeal of this Act, persons holding office under this Act continue to hold office until their terms expire and are, for that purpose, deemed to have been appointed or elected under the University Act.
