B.C. Reg. 452/2003, deposited December 5, 2003, pursuant to the INSURANCE (MOTOR VEHICLE) ACT [Section 45]. Order in Council 1168/2003, approved and ordered December 4, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) effective January 1, 2004, sections 1 to 8 and 10 to 14 of the attached Appendix amend the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, B.C. Reg. 447/83, and

(b) effective February 22, 2004, section 9 of the attached Appendix amends B.C. Reg 447/83. — R. COLEMAN, Minister of Public Safety and Solicitor General; G. ABBOTT, Presiding Member of the Executive Council.

Appendix

1 Section 46 (2) of B.C. Reg 147/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, is repealed.

2 Section 53 (1) is amended by striking out "Parts 6, 7 and 10" and substituting "Parts 6 and 7 and Division 1 of Part 10".

3 Section 61 (3) is repealed.

4 Section 125 is amended

(a) in subsection (2) by striking out "Subject to subsection (3)" and substituting "Subject to subsections (2.1) and (3)", and

(b) by adding the following subsection:

(2.1) Except in the case of the theft of an entire motor vehicle, subsection (2) applies only if the corporation has paid for a claim for loss or damage for which coverage under this Division is provided by the owner's certificate with respect to the motor vehicle.

5 Section 148.1 is amended

(a) by adding the following definition:

"assigned corporate driver" means a person assigned by the owner or lessee named in an owner's certificate to be the principal driver of a vehicle described in the owner's certificate if

(a) the owner or lessee is not an individual, and

(b) the assigned vehicle is a taxable benefit to the assigned person under the Income Tax Act (Canada); , and

(b) in the definition of "insured" by

(i) striking out "or" at the end of paragraph (b) (i),

(ii) adding the following paragraph

(i.1) an assigned corporate driver, or, and

(iii) amending subparagraph (ii) by adding "or (i.1)" after "subparagraph (i)".

6 Sections 148.5 and 148.6 are repealed.

7 Section 158 is repealed and the following substituted:

Disclosure of fleet identify number

158 A fleet operator must set out the fleet identity number on every application for a new or renewed certificate or endorsement in respect of a vehicle in the fleet.

8 Schedule 1 is amended

(a) in section 2 (7) (b) of Table 2 by adding "011, 012, 013, 014, 015, 017," after "007,", and

(b) by repealing the Vehicle Use Tables with respect to rate classes 021, 022, 023, 024, 027, 701, 705, 710, 711, 712, 713, 714, 720, 721, 722, 723 and 724 and substituting the Vehicle Use Tables in the attached Schedule 1.

9 Schedule 1 is amended by repealing the Vehicle Use Tables with respect to rate classes 030, 035, and 100 and substituting the Vehicle Use Tables in the attached Schedule 2.

10 Schedule 5 is amended by repealing forms APV31, APV33 and APV49 and substituting the forms in the attached Schedule 3.

11 Schedule 6 is amended by repealing forms APV40, APV281, APV334, APV334L and APV348 and substituting the forms in the attached Schedule 4.

12 Section 1 of Schedule 8 is amended

(a) in subsection (1) by striking out "in 2003" and "on or after January 1, 2003",

(b) in subsection (2) (b) by striking out "on or after January 1, 2003", and

(c) in subsection (2) by striking out "in 2003 shall be" and substituting "must be".

13 Section 3 of Schedule 8 is amended

(a) in subsection (1) by striking out "in 2003", and

(b) by repealing subsection (2) and substituting the following:

(2) The discount for renewal of insurance for a fleet that commenced to insure as a fleet on or after January 1 in the preceding calendar year but before January 1 in the current calendar year and continues to insure as a fleet is 15%.

14 Section 4 of Schedule 8 is amended by striking out "in 2003".
