Definitions

1 In this regulation:

"Act" means the Forest and Range Practices Act;

"Code" means the Forest Practices Code of British Columbia Act as it was immediately before the effective date;

"Code regulations" means

(a) the regulations under the Code, and

(b) the standards under the Code

as they were immediately before the effective date;

"effective date" means the date section 177 of the Act comes into force.

Penalties

2 Subject to section 4, a penalty set out in Column 3 of Schedule 1 is the maximum penalty, in dollars, which may be levied under section 71 (2) of the Act for each contravention of each provision in Column 2 opposite the penalty, of the corresponding statute or regulation in Column 1.

Penalties expressed as amounts per m³ or hectare

3 If

(a) the maximum penalty in Schedule 1 or 2 is expressed as an amount per hectare of timber affected, or m³ of timber affected, and

(b) only a fraction of a hectare or m³ of timber was affected,

the maximum penalty is the amount per hectare or m³ set out in Column 3 of the applicable Schedule multiplied by the fraction of hectare or m³ of timber affected.

Penalties — transitional

4 (1) Schedule 2 applies to a person described in Part 11 of the Act who the minister has determined under section 71 (2) of the Act to have contravened a provision of the Code or the Code regulations.

(2) If Schedule 2 applies, a penalty set out in Column 3 of Schedule 2 is the maximum penalty, in dollars, which may be levied under section 71 (2) of the Act for each contravention of each provision in Column 2 opposite the penalty of the corresponding statute or regulation in Column 1.
