B.C. Reg. 145/2004, deposited March 26, 2004, pursuant to the WILDLIFE ACT [Section 108]. Order in Council 330/2004, approved and ordered March 25, 2004.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Freshwater Fish Regulation, B.C. Reg. 261/83, is amended according to the attached schedule.

Schedule

1 The Freshwater Fish Regulation, B.C. Reg. 261/83, is amended by repealing section 1 and substituting the following:

Interpretation

1 In this regulation, "fish" means a freshwater species of

(a) Order Petromyzoniformes (lampreys),

(b) Class Osteichthyes (bony fishes),

(c) Class Crustacea (crustaceans), or

(d) Class Mollusca

and their eggs and juvenile stages, but does not include

(e) goldfish, or

(f) species of ornamental tropical fishes.

2 The following sections are added:

Authorization by permit

3 A regional manager or a person authorized by a regional manager may issue a permit in accordance with this regulation on the terms and for the period he or she specifies authorizing a person  to

(a) possess

(b) transport, or

(c) traffic in

live fish.

Fee for authorization by permit

4 The fee for a permit issued under section 3 is $25 and the habitat conservation trust fund surcharge to be paid is $5.
