B.C. Reg. 155/2004, deposited April 1, 2004, pursuant to the RAILWAY SAFETY ACT [Section 23]. Order in Council 347/2004, approved and ordered April 1, 2004.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the following regulation is made, effective April 1, 2004:
RAILWAY SAFETY ACT TRANSITION REGULATION
1 In this regulation:
"Act" means the Railway Safety Act;
"recreational railway" has the same meaning as in the Elevating Devices Safety Regulation, B.C. Reg. 101/2004;
"regulations" means the Occupational Safety and Health Regulation, B.C. Reg. 74/93 and the Workplace Hazardous Materials Information System Regulation (Railways), B.C. Reg. 277/88.
2 (1) Subject to subsection (2), the regulations do not apply to railway companies.
(2) The regulations apply to the British Columbia Railway Company until its authorization under the Railway Act becomes invalid under section 24 of the Act.
3 If a railway company is issued an operating permit under the Safety Standards Act for a recreational railway, the company's authorization under the Railway Act with respect to recreational railways is invalid on and after the date the permit is issued.
