B.C. Reg. 193/2004, deposited April 30, 2004, pursuant to the SPECIAL ACCOUNTS APPROPRIATION AND CONTROL ACT [Section 10 (2)] and the MISCELLANEOUS STATUTES AMENDMENT ACT, 2003 [Section 71 (1)]. Order in Council 433/2004, approved and ordered April 29, 2004.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

1 sections 57 and 58 of the Miscellaneous Statutes Amendment Act, 2003, S.B.C. 2003, c. 7, are brought into force by this regulation, and

2 the following regulation is made:

FORFEITED CRIME PROCEEDS FUND REGULATION

Definition

1 In this regulation, "Act" means the Special Accounts Appropriation and Control Act.

Relevant provisions

2 (1) For the purpose of section 7 (1) of the Act, the following provisions of the Criminal Code (Canada) are relevant provisions:

(a) section 83.14 (5);

(b) section 490.1 (1) and (2);

(c) section 490.2 (2).

(2) For the purpose of section 7 (1) of the Act, the following provisions of the Controlled Drugs and Substances Act (Canada) are relevant provisions:

(a) section 16 (1) and (2);

(b) section 17 (2).
