1 An offer for sale or lease, the sale or lease and any assistance in the selling or leasing of the subdivided land that comprises all or part of the land described as:

Section 21, Township 7, New Westminster District,
by or on behalf of Kingswood Capital Corporation, Progressive Construction Ltd. and Campbell Heights Limited Partnership, is exempt from all of the provisions of Part 2 of the Real Estate Act on condition that
(a) Kingswood Capital Corporation, Progressive Construction Ltd. and Campbell Heights Limited Partnership will advertise for sale or lease or otherwise market the lots for commercial or industrial purposes only,
(b) the land is used for commercial or industrial purposes only, and
(c) Kingswood Capital Corporation, Progressive Construction Ltd. and Campbell Heights Limited Partnership will notify all purchasers or lessees at the time of an offer for sale or lease that the offering is exempt from the provisions of Part 2 of the Real Estate Act and that they will not receive a prospectus or a disclosure statement under the Real Estate Act and will not have the benefit of any rights or protections afforded by Part 2 of that Act.
