B.C. Reg. 259/2004, deposited June 11, 2004, pursuant to the GEOTHERMAL RESOURCES ACT [Section 24]. Order in Council 554/2004, approved and ordered June 10, 2004.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Geothermal Resources Administrative Regulation, B.C. Reg. 132/83, is amended as set out in the Appendix.

Appendix

1 Section 1 of B.C. Reg. 132/83, the Geothermal Resources Administration Regulation, is amended by adding the following definition:

"director" means the Director of Petroleum Lands.

2 Section 2 (2) (a) and (3) is repealed.

3 Section 4 (3) (iii), (4), (5) and (8) is repealed and the following subsections are added:

(4) Each well referred to on a plan must be described on the plan by use of the Petroleum and Natural Gas Grid.

(9) On examination and acceptance of a plan, the Surveyor General must indicate by notation on the plan that it has been approved.

4 Section 6 is amended

(a) in subsection (1) by deleting ", a geothermal rig licence" and ", geothermal rig licence", and

(b) in subsection (3) (a) deleting "commissioner or".

5 Section 7 is amended by deleting ", geothermal rig licence".

6 Section 9 (4) is amended by deleting "commissioner" wherever it appears and substituting "director".

7 Section 10 is amended

(a) in subsection (1) by deleting "commissioner" wherever it appears and substituting "director" , and

(b) by repealing subsection (2).

8 Section 12 is amended by deleting "commissioner" wherever it appears and substituting "director".

9 Section 14 (2) (a) and (d) is amended by repealing subsection (2) (a) and (d).

10 Schedule 2 is amended

(a) by deleting "and be prepared in accordance with the following procedures",

(b) by repealing paragraphs (d) to (m), and

(c) by repealing everything following paragraph (m).
