I, Bill Barisoff, Minister of Water, Land and Air Protection, order that the Hunting Regulation, B.C. Reg. 190/84, is amended as set out in the attached Appendix.

Appendix

1 The Hunting Regulation, B.C. Reg. 190/84, is amended by adding the following section:

Open season

13.3 There is no open season for a spotted cougar kitten or any cougar accompanying it.

2 Section 16 is amended

(a) by repealing subsection (1) and substituting the following:

(1) A person commits an offence if the person takes or kills,

(a) in Region 2 or 8 or in M.U.s 7-02 to 7-15, 7-17 or 7-24 to 7-26, an elk,

(b) in any M.U., a caribou, or

(c) in any M.U. except in Region 4 (Kootenay) or in Region 6 (Skeena), a cougar

unless within 30 days after the date of the kill, or before exporting it from the Province, the person submits the prescribed parts of the animal to an officer for inspection and measurement. ,

(b) in subsection (2)

(i) by striking out "15 days" wherever it appears and substituting "30 days", and

(ii) in paragraph (b) (ii) by striking out "grizzly bear, mountain goat, mountain sheep, or",

(c) by adding the following subsections:

(2.1) A person commits an offence if the person takes or kills, in any M.U.,

(a) a grizzly bear,

(b) a mountain goat, or

(c) a mountain sheep,

unless the person submits the prescribed parts of the animal to an officer for inspection and measurement

(d) within 30 days after the date of the kill,

(e) before exporting the animal from the Province, and

(f) before December 5 of the year of the kill.

(2.2) A person does not commit an offence under subsection (2.1) if

(a) with the written approval of an officer, the prescribed parts of a big game animal are submitted for inspection within 30 days after the last day of the hunt, or

(b) the person uses the services of a licensed guide to kill a grizzly bear, mountain goat or mountain sheep in any region, and the person submits the prescribed parts of the animal to an officer for inspection and measurement

(i) within 30 days after the last day of the continuous season in which the big game animal was killed;

(ii) before exporting the animal from the Province;

(iii) before December 5 of the year of the kill.

(3.1) A person commits an offence if the person takes or kills a cougar in a M.U. in Region 6 (Skeena) unless, within 4 days of the date of kill or before exporting it from the Province, whichever first occurs, the prescribed parts are submitted to an officer in Region 6 (Skeena) for inspection and measurement. ,

(d) in subsection (4) by striking out "For subsections (1), (2) and (3)" and substituting "For subsections (1), (2), (2.1), (2.2), (3) and (3.1)",

(e) in subsection (5) (a) by striking out "subsections (1) or (3)" wherever it appears and substituting "subsection (1), (2.1), (3) or (3.1)", and

(f) in subsection (6) (a) by striking out "within 15 days" and substituting "within 30 days".

3 Section 16.1 is amended

(a) by repealing subsection (1) (g) and substituting the following:

(g) in Region 4, a bearded turkey, , and

(b) in subsection (1) by striking out everything after paragraph (g) and substituting "commits an offence if he or she fails, within 30 days after the date of the kill, to report in person or by mail to the Wildlife Branch the place and the date of the kill, the number of days hunted before the animal was killed, and the sex of the animal."

4 Section 18 (1) (j) is amended by adding "other than for hunting wolf, coyote, cougar, lynx or bobcat, or" at the end.

5 Section 19 is amended

(a) in subsection (1) by striking out the following items:

6 Part 1 of Schedule 1 is repealed and the attached Part 1 of Schedule 1 is substituted.

7 Part 2 of Schedule 1 is amended

(a) in section 1

(i) in subsections (6), (8), (12) and (14) by striking out "September 6 to December 10" and substituting "September 11 to December  10",

(ii) in subsection (7) by striking out "August 23" and substituting "August 28", and

(iii) by adding the following subsection:

(16) On those portions of M.U. 1-06 known as Denman and Hornby Islands, the open season for mule (black-tailed) deer bucks is from the first Saturday in October to December 10. ,

(b) in section 4 (1)

(i) in paragraphs (a) and (c) by striking out "August  23 to September 5" and substituting "August 28 to September 10", and

(ii) in paragraph (b) by striking out "August 23 to August  29" and substituting "August 28 to September 3",

(b) in subsection (2) by striking out "September 6 to September 7" and substituting "September 4 to September 5".

10 Part 1 of Schedule 3 is repealed and the attached Part 1 of Schedule 3 is substituted.

11 Part 2 of Schedule 3 is amended in section 7 (1) by striking out "September  6 to September 7" and substituting "September 4 to September 5".

12 Part 1 of Schedule 4 is repealed and the attached Part 1 of Schedule 4 is substituted.

13 Part 2 of Schedule 4 is amended

(a) in section 8

(i) in subsection (6) (a) by striking out "September  10, 2003 to February 28, 2004," and substituting "September 10, 2004 to February 28, 2005,",

(ii) in subsection (6) (b) by striking out "September  10, 2003" and substituting "September 10, 2004" and by striking out "since April 1, 2003 is 25" and substituting "since April 1, 2005 is 20",

(a) in section 10 by adding the following subsection:

(3) The general open season for spike-fork bull moose in M.U.s 5-01 to 5-06 and 5-10 to 5-15 is September 10 to October 31. , and

(b) in section 13 (1) by striking out "September 6 to September 7" and substituting "September 11 to September 12".

16 Part 1 of Schedule 6 is repealed and the attached Part 1 of Schedule 6 is substituted.

17 Part 2 of Schedule 6 is amended

(a) in section 6 (2) by striking out "M.U.s 6-1 to 6-11, 6-14, 6-15 and 6-30" and substituting "M.U.s 6-1 to 6-11, 6-14-6-16 and 6-30",

(b) by adding the following section:

Cougar

17 The open season for cougar in M.U.s 6-1 to 6-11 is

(a) September 10, 2004 to April 30, 2005, or

(b) September 10, 2004 until 72 hours after the regional manager has published that the total number of female cougar killed in M.U.s 6-1 to 6-11 since April 1, 2005 is 5. ,

(c) in section 11

(i) in subsection (1) by striking out "November 20" and substituting "November 30" and by striking out "M.U.s 6-1, 6-2 and 6-4 to 6-9" and substituting "M.U.s 6-1, 6-2, 6-4 to 6-9 and 6-30",

18 Part 3 of Schedule 6 is amended by adding the following section:

Cougar

3 The bag limit for cougar in MU.s 6-1 to 6-11 is one.

19 Part 1 of Schedule 7 is repealed and the attached Part 1 of Schedule 7 is substituted.

20 Part 2 of Schedule 7 is amended

(a) in section 7 (4) (b) by striking out "M.U.'s 7-50, 7-54 and 7-57" and substituting "M.U.'s 7-50 to 7-54 and 7-57",

(b) in section 13 (2) by striking out "October 1 to October 31" and substituting "October 1 to October 15", and

(c) by adding the following sections:

Wolf

25 Despite Part 1 of Schedule 7, and for the purposes of section 26 (1) (c) of the Act, there is no closed season for wolf in those portions of M.U.s 7-19 to 7-22, 7-31 to 7-36 and 7-42 to 7-58 below the 1 100 m elevation.

Antlerless elk

26 Despite Part 1 of Schedule 7, and for purposes of section 26 (1) (c) of the Act, a person may hunt antlerless elk in M.U.s 7-20, 7-21 and 7-32 to 7-35 from October 5 to October 10

(a) on private property, and

(b) on Crown land within 400 metres of private property.

Antlerless mule deer

27 Despite Part 1 of Schedule 7, and for purposes of section 26 (1) (c) of the Act, a person may hunt antlerless mule deer on private property in M.U.s 7-20, 7-21 and 7-32 to 7-35 from October 5 to October 10.

21 Part 3 of Schedule 7 is amended by repealing section 2 and substituting the following:

Thinhorn mountain sheep bag limit

2 (1) The regional bag limit for thinhorn sheep is one sheep in 3 years.

(2) A hunter who harvests a thinhorn sheep must not hunt or kill another thinhorn sheep until the calendar year of the kill and two subsequent calendar years have expired.

22 Part 1 of Schedule 8 is repealed and the attached Part 1 of Schedule 8 is substituted.

23 Part 2 of Schedule 8 is amended

(a) in section 10 (1) by striking out "September 10 to September 11" and substituting "September 4 to September 5",

(b) by adding the following section:

Cougar

12 (1) In addition to section 18 (2) of Division 7, a person who

(a) is not in possession of a firearm, and

(b) is in possession of a hunting licence.

does not commit an offence under section 78 of the Act if he or she allows a dog to pursue cougar or accompanies a person who allows a dog to pursue cougar during the period March 1 to March 31 in M.U.s 8-01 to 8-26.

(2) Subsection (1) does not apply if the cougar is subsequently injured or killed. , and

(c) by adding the following section:

Black bear

13 Despite Part 1 of Schedule 8, a person may hunt black bear on private property in M.U.s 8-01 to 8-26 from August 1 to August 31.
