B.C. Reg. 354/2004, deposited July 23, 2004, pursuant to the FOREST AND RANGE PRACTICES ACT [Sections 22.1, 141, 148 and 155]. Order in Council 794/2004, approved and ordered July 22, 2004.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

(a) the Forest Recreation Regulation, B.C. Reg. 16/2004, is amended as set out in the attached Schedule A, and

(b) the Forest Service Road Use Regulation, B.C. Reg. 70/2004, is amended as set out in the attached Schedule B.

Schedule A

1 Sections 6 (4) and 23 (1) of the Forest Recreation Regulation, B.C. Reg. 16/2004, are amended by striking out "a designated forest official, a designated environment official or a peace officer" and substituting "an official or a peace officer" .

2 Sections 8, 11 (2), 13 (1), 14, 16, 17 (b), 20 (1) (c) and 22 (8) (c) are amended by striking out "a designated forest official" and substituting "an official" .

3 Section 12 (2) is amended by striking out "A designated forest official, a designated environment official or a peace officer" and substituting "An official or a peace officer".

4 Section 15 is repealed and the following is substituted:

Structures

15 (1) A person must not erect a structure or post a sign or a poster on a recreation site, recreation trail or interpretive forest site unless authorized by an official.

(2) An official may cause a structure, sign or poster referred to in subsection (1) to be altered or removed without compensation, whether or not it was erected or posted with the official's permission.

5 Section 20 is amended

(a) in subsection (2) (a) by striking out "the designated forest official" and substituting "the official" , and

(b) in subsections (2), (3) and (5) by striking out "A designated forest official" and substituting "An official" .

Schedule B

1 Section 6 (1) of the Forest Service Road Use Regulation, B.C. Reg. 70/2004, is amended by striking out "a designated forest official" and substituting "an official" .

2 Section 12 (1) (b) is amended by striking out ", designated forest official, designated environment official or conservation officer under the Wildlife Act" and substituting "or an official" .
