B.C. Reg. 368/2004, deposited July 23, 2004, pursuant to the OFFENCE ACT [Sections 81 (2) and 132]. Order in Council 761/2004, approved and ordered July 22, 2004.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

(a) Schedules 1 and 2 to the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, are amended as set out in sections 1 and 2 of the attached Schedule, and

(b) the Schedule to the Investigation and Prosecution Costs Regulation, B.C. Reg. 227/90, is amended as set out in section 3 of the attached Schedule.

Schedule

Violation Ticket Administration
and Fines Regulation

1 Schedule 1 of the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended

(a) in column 2 of item 1, in the paragraph (p) following "The provisions, referred to in Column 1 of Schedule 2, of the following enactments:" by striking out "Waste Management Act" in both places and substituting "Environmental Management Act",

(b) in column 2 of item 8 by striking out "Waste Management Act" and substituting "Environmental Management Act",

(c) in column 1 of item 10 by striking out "Environment Management Act" and substituting "Environmental Management Act",

(d) in column 2 of item 10 by striking out "123 and 204 of the Motor Vehicle Act" and substituting "123, 177 and 204 of the Motor Vehicle Act",

(e) in column 2 of item 10 in paragraph (g) by striking out "Waste Management Act" in both places and substituting "Environmental Management Act",

(f) in column 2 of item 17 by striking out "Sections 9.1 (2) and 9.2 of the Waste Management Act" and substituting "Sections 12 (2) and 13 of the Environmental Management Act",

(g) in column 1 of item 18 by adding after "or as an official under section 1 of the Forest and Range Practices Act" after "Forest Practices Code of British Columbia Act",

(h) in column 2 of item 18 by striking out "Sections 9.1 (2) and 9.2 of the Waste Management Act" and substituting "Sections 12 (2) and 13 of the Environmental Management Act",

(i) in column 2 of item 23 by striking out "Sections 3, 7 (1) and (7), 9 (1) and 11 (3), (4) and (6) of" and substituting "Sections 9 (1) (a) and 11 (6) of", and

(j) in column 3 of item 23 by striking out "Sections 10 (1) and 11 (5), (7), (8), (9) and (10) of" and substituting "Sections 10 (1) and 11 (7) and (10) of".

2 Schedule 2 is amended

(a) under the Park and Recreation Area Regulation, B.C. Reg. 180/90, by striking out everything in columns 1, 2, 3, 4 and 5 below "section 39 (2)" and substituting the following:

(b) in column 1 by repealing the title and all the entries for "Waste Management Act" and substituting the following:

INVESTIGATION AND PROSECUTION COSTS REGULATION

3 The Schedule to the Investigation and Prosecution Costs Regulation, B.C. Reg. 227/90, is amended by repealing the title and all the entries for "Environment Management Act" and "Waste Management Act" and substituting the following:

section 120 (2) (b) contravenes section 10 (1) (a), (b) or (c) or (2)
section 120 (3) (a) contravenes section 6 (2), (3) or (4)
