B.C. Reg. 378/2004, deposited August 3, 2004, pursuant to the ASSESSMENT ACT [Section 24 (7) and (8)]. Regulation of the Assessment Commissioner, dated August 3, 2004.

I, Doug Rundell, Assessment Commissioner under the Assessment Act, amend the Forest Land and Cut Timber Values Regulation, B.C. Reg. 90/2000, as set out in the attached Schedule.

Schedule

1 The Forest Land and Cut Timber Values Regulation, B.C. Reg. 90/2000, is amended by repealing the title and substituting the following:

MANAGED FOREST LAND AND CUT TIMBER
VALUES REGULATION

2 Section 1 is amended by adding the following definition:

"Act" means the Assessment Act;

3 Section 2 is amended

(a) by striking out "shall" and substituting "must", and

(b) by striking out "2004" and substituting "2005".

4 Section 3 (1) is amended

(a) by adding "managed" before "forest land", and

(b) by striking out "established by him" and substituting "established by the commissioner".

5 Section 4 (1) is amended by adding "managed forest" before "land".

6 The following section is added:

Additional requirements for classification of land as managed forest land

6 (1) In this section:

"land" means a parcel or contiguous parcels of land;

"October 31" means October 31 of the year preceding the year for which the assessment roll is completed;

"Prescribed Classes regulation" means the Prescribed Classes of Property Regulation, B.C. Reg. 438/81.

(2) To be classified as managed forest land under the Prescribed Classes regulation and section 24 of the Act, the land

(a) must measure at least 25 hectares, and

(b) must be managed as a single unit under

(i) a management commitment pursuant to section 17 of the Private Managed Forest Land Act, or

(ii) a management plan approved under the Forest Act.

(3) In addition to the requirements set out in subsection (2), to be classified as managed forest land under the Prescribed Classes regulation and section 24 of the Act,

(a) if the land measures 50 hectares or less, at least 70% of the land must be productive during the year ending on October 31, or

(b) if the land measures more than 50 hectares, at least 50% of the land must be productive during the year ending on October 31.
