B.C. Reg. 431/2004, deposited October 1, 2004, pursuant to the HEALTH CARE (CONSENT) AND CARE FACILITY (ADMISSION) ACT [Section 34]. Order in Council 943/2004, approved and ordered September 30, 2004.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the Health Care Consent Regulation, B.C. Reg. 20/2000, is amended as set out in the schedule to this order.

Schedule

1 Section 1 of the Health Care Consent Regulation, B.C. Reg. 20/2000, is amended

(a) in subsection (1) by repealing the definitions "board", "chair", "community health services society", "hearing" and "review",

(b) in subsection (1) by repealing the definition "health care body" and substituting the following definition:

"health care body" means either of the following:

(a) a health care body as defined in the Freedom of Information and Protection of Privacy Act;

(b) a facility licensed under the Community Care and Assisted Living Act; , and

(c) by repealing subsection (2).

2 Section 2 is repealed and the following substituted:

2 The following committees are designated for the purposes of paragraph (b) of the definition of "health care" in section 1 of the Act:

(a) University of British Columbia — British Columbia Cancer Agency Research Ethics Board;

(b) University of British Columbia — Clinical Research Ethics Board;

(c) University of British Columbia — Behavioural Research Ethics Board;

(d) Simon Fraser University — Research Ethics Review Committee;

(e) University of Victoria — Human Research Ethics Committee;

(f) University of British Columbia — Providence Health Care Research Ethics Board;

(g) Vancouver Island Health Authority Research Review and Ethical Approval Committee;

(h) Clinical Investigation Committee, Fraser North;

(i) South Fraser Regional Research Review Committee;

(j) Kelowna General Hospital Research Committee;

(k) Prince George Regional Hospital Research Review Committee;

(l) Penticton Regional Hospital Ethics Committee;

(m) Interior Health Research Ethics Review Committee.

3 Section 5 is amended by repealing subsections (2) and (3).

4 Part 3 is repealed.

5 Form 1 is amended by striking out:

You, your spouse or a relative or friend of yours has the right to request a review of the decision to give or refuse substitute consent for the health care described above. A request for a review must be delivered to the Health Care and Care Facility Review Board within 72 hours after the decision to give or refuse substitute consent for the health care described above was made.
