On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the regulations named in the appendices to this order are amended as set out in those appendices.

Appendix 1
The Extended Health Care and Dental Plans Regulation, B.C. Reg. 403/97, is amended in section 2
(a) in paragraph (dd) by striking out "Oak Bay Lodge Society" and substituting "OBL Continuing Care Society", and
(b) by adding the following paragraph:
(ddd) eligible employees of the Business Practices and Consumer Protection Authority, .
Appendix 2
1 The Group Life Insurance Regulation (No. 1), B.C. Reg. 408/97, is amended in section 2
(a) in paragraphs (oo) and (pp), by striking out "Oak Bay Lodge Society" and substituting "OBL Continuing Care Society", and
(b) by adding the following paragraphs:
(eeee) eligible bargaining unit employees of the Business Practices and Consumer Protection Authority;
(ffff) eligible excluded employees of the Business Practices and Consumer Protection Authority.
2 Section 4 is amended by striking out "and (dddd)" and substituting ", (dddd) and (ffff)".
3 Section 5 (a) is amended by striking out "or (cccc)" and substituting ", (cccc) or (eeee)" .
4 Sections 5 (a) (i) and (ii) and 5.1 (b) are amended by adding the following row:

Appendix 3
1 The Long Term Disability Plan Regulation, B.C. Reg. 409/97, is amended in section 1.1 by adding the following definition:
"basic pay" means the rate of pay for the job, including add-to-pay resulting from salary protection; .
2 Section 1.2 is amended
(a) by repealing paragraph (a) and substituting the following:
(a) The Long Term Disability benefit is calculated on basic pay. ,
(b) in paragraph (b) by striking out "basic salary" and substituting "basic pay", and
(c) by adding the following paragraph:
(d) To maintain coverage while on a leave of absence without pay, the rate of contribution of an employee towards payment of premiums is established by the Plan Administrator.
3 Section 2.1 is amended by striking out "Plan Type A, B, C, F or G" and substituting "Plan Type A, B, F or G".
4 Section 2.2 is amended
(a) by renumbering paragraph (a) as (a.1), and by adding the following paragraph before paragraph (a.1):
(a) During the Long Term Disability Plan period under paragraph (a), employees will be considered to be on LTD status as described in paragraph (d), and therefore not entitled to vacation or other benefit credits. ,
(b) in paragraph (a) (ii) by adding the following to the list of Plan Types:
Plan Type I — 68.3 percent of the first $2 500 of monthly earnings and 50 percent of the monthly earnings above $2 500. ,
(c) in paragraph (b) by striking out "salary" and substituting "basic pay", and
(d) by adding the following paragraph:
(g) Benefit Continuation — coverage under the LTD Plan continues uninterrupted if an employee is
(i) granted leave of absence with pay,
(ii) working at least half time on a regularly scheduled basis,
(iii) transferred or granted a break in service or leave of absence without pay for a period of less than one full calendar month and returns to service, either to the same group or to another group covered under these plans with the exception of the wage loss benefits, or
(iv) on an approved maternity/parental/adoption leave authorized by the applicable terms and conditions of employment.
5 Section 2.3 is amended
(a) in paragraph (b) by adding the following paragraphs:
For employees covered by Plan Type I, "total disability", as used in this Plan, means the complete inability, because of accident or illness, of a covered employee to perform all the duties of his or her own occupation for the first two years (24 months) of disability.
For employees covered by Plan Type J, "total disability", as used in this Plan, means the complete inability, because of accident or illness, of a covered employee to perform all the duties of his or her own occupation. , and
(b) in paragraph (e) (i) by striking out "Plan Type A, B, F, G or H" and substituting "Plan Type A, B, F, G, H or I".
6 Section 2.6 (f) is amended by striking out "Plan Type A, B, F, G, H or J" and substituting "Plan Type A, B, F, G, H, I or J".
7 Section 2.8 is amended by adding the following paragraph:
(d) When a regular employee becomes an auxiliary employee, LTD Plan Coverage ceases on the date of employment status change.
8 Section 2.9 is amended by adding "In the case of deferred salary leave, coverage is permitted for a period of 12 months" after "extended to two (2) years".
9 Section 2.13 is amended
(a) in paragraph (b) by striking out "Plan Type A, B, F, G, H or J" and substituting "Plan Type A, B, F, G, H, I or J", and
(b) in paragraph (f) by striking out "Plan Type A, B, H or J" and substituting "Plan Type A, B, H, I or J".
10 Section 2.20 is amended
(a) by striking out "Plan Type A" and substituting "Plan Type A or B", and
(b) in paragraph (f) by striking out "the Government Employee Health Services" and substituting "Occupational Health Programs".
11 Schedule A is amended in section A
(a) by repealing paragraph (j),
(b) in paragraph (hh) by striking out "Oak Bay Lodge Society" and substituting "OBL Continuing Care Society", and
(c) by adding the following paragraph:
(bbb) all eligible regular excluded employees of the Business Practices and Consumer Protection Authority.
12 Schedule A is amended in section B
(a) in paragraphs (m), (q) and (u) by striking out "Oak Bay Lodge Society" and substituting "OBL Continuing Care Society", and
(b) by adding the following paragraph:
(gg) all eligible regular bargaining unit employees of the Business Practices and Consumer Protection Authority.
13 Schedule A is amended by adding the following section:
J Plan Type I applies to judicial justices of the peace appointed under the Provincial Court Act.
