B.C. Reg. 457/2004, deposited October 22, 2004, pursuant to the COMMUNITY CARE AND ASSISTED LIVING ACT [Section 34 (2)]. Order in Council 1023/2004, approved and ordered October 21, 2004.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) the Adult Care Regulations, B.C. Reg. 536/80, is amended by the attached Schedule 1, and

(b) the Child Care Licensing Regulation, B.C. Reg. 319/89, is amended by the attached Schedule 2.

Schedule 1

1 Section 1 of the Adult Care Regulations, B.C. Reg. 536/80, is amended by repealing the definition of "registered dietitian-nutritionist" and substituting the following:

"dietitian" means a person who is a registrant of the College of Dietitians of British Columbia; .

2 Section 2.1 (2) (b) is repealed and the following substituted:

(b) provides not more than 2 prescribed services.

3 Section 6.2 (a) (i) is amended by striking out "medical certificate" and substituting "certificate from a medical practitioner".

4 Section 6.10 is re-enacted as follows:

Care and supervision

6.10 A licensee must provide to all persons in care a level of care and supervision that, in the opinion of the medical health officer, is appropriate to meet the needs of the persons in care.

5 Sections 7 (2), 7.1 and 7.2 (1) (c) are amended by striking out "registered dietitian-nutritionist" and substituting "dietitian".

6 Section 10.8 is amended by striking out "the Schedule" and substituting "Schedule 1".

Schedule 2

1 Section 1 of the Child Care Licensing Regulation, B.C. Reg. 319/89, is amended in the definition of "director of the early childhood educator registry" by striking out "who occupies the position of Executive Director of the Child Care Programs and Services Branch of the Ministry of Community, Aboriginal and Women's Affairs" and substituting "described in section 8".

2 Section 8 is repealed and the following substituted:

Director of the early childhood educator registry

8 (1) The director of the early childhood educator registry is the person who occupies the position of Executive Director of the Child Care Programs and Services Branch of the Ministry of Children and Family Development.

(2) The director of licensing must perform the duties and functions of the director of the early childhood educator registry if all of the following apply:

(a) there is no person described in subsection (1) or that person is unable to act;

(b) there is no person acting for a person described in subsection (1) or that person is unable to act;

(c) there is no deputy to a person described in subsection (1) or that person is unable to act.

3 Section 10 (1) (a) is amended by striking out "section 7" and substituting "section 9".

4 Section 13 (2) (a) and (3) (a) are amended by striking out "meets the requirements of section 6 (2) of this regulation," and substituting "is of good character,".

5 Section 66.1 is added as follows:

Age of persons in care

66.1 A licensee must ensure that each person in care in a residential care facility is less than 19 years of age.

6 Schedule B is amended in item 1 by striking out "Metro Training Inc.", and by adding "MTI Community College" and "Ridge Meadows College".

7 Schedule C is amended

(a) by repealing item 6, and

(b) by adding the following item:

13 HeartSafe Emergency Medical Solutions .

8 Schedule G is amended

(a) in section 1 by adding to the list of provisions the following:

8 [certification of educators of children]; , and

(b) in section 2 by adding to the list of provisions the following:

9 [qualifications for an early childhood educator certificate];

10 [qualifications for other certificates];

13 [expiry and renewal of a certificate];

14 [variation, suspension or cancellation of a certificate]; .
