B.C. Reg. 85/2012, deposited April 20, 2012, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [section 35] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [section 26]. Order in Council 244/2012, approved and ordered April 19, 2012.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective May 1, 2012,

(a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in Schedule 1, and

(b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in Schedule 2.

Schedule 1

1 Section 4.1 (2) (b) of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended by striking out "subsection (4)" and substituting "subsections (4), (5) and (6)".

2 Section 4.2 (3) (b) is amended

(a) by striking out "subsection (4)" and substituting "subsection (5)",

(b) by striking out everything after "program" and substituting ", and".

3 Section 11 (1) is amended by repealing paragraphs (z) and (cc) and adding the following paragraphs:

(pp) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Family Support Services program;

(qq) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Supported Child Development program;

(rr) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Aboriginal Supported Child Development program.

4 Section 33 (1) (b) is amended by adding the following subparagraph:

(vi) any warrants as described in section 15.2 (1) of the Act.

5 Section 1 (a) of Schedule B is amended by repealing subparagraphs (xx) and (xxiii) and adding the following subparagraphs:

(xxxix) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Family Support Services program;

(xl) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Supported Child Development program;

(xli) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Aboriginal Supported Child Development program, .

6 Section 1 of Schedule C is amended by adding the following definitions:

"hearing instrument" has the same meaning as in the Speech and Hearing Health Professionals Regulation, B.C. Reg. 413/2008;

"occupational therapist" means an occupational therapist registered with the College of Occupational Therapists of British Columbia established under the Health Professions Act;

"physical therapist" means a physical therapist registered with the College of Physical Therapists of British Columbia established under the Health Professions Act;

"physical therapy" has the same meaning as in the Physical Therapists Regulation, B.C. Reg. 288/2008; .

7 Section 2 of Schedule C is amended

(a) in subsection (1) (c) by repealing Item 6 of the table and substituting the following:

(b) in subsection (2) by striking out "physiotherapy" and substituting "physical therapy", and

8 Section 3.11 of Schedule C is amended

(a) by striking out "hearing aid" each place it appears and substituting "hearing instrument", and

(b) by striking out "hearing aid dealer or consultant" each place it appears and substituting "hearing instrument practitioner".

9 Section 8 (1) (i) of Schedule C is amended by adding "low" before "phenylalanine".

10 Section 6 of Schedule D is amended by repealing paragraphs (s) and (v) and adding the following paragraphs before Table 1:

(jj) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Family Support Services program;

(kk) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Supported Child Development program;

(ll) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Aboriginal Supported Child Development program.

Schedule 2

3 Section 10 (1) is amended by repealing paragraphs (z) and (cc) and adding the following paragraphs:

(pp) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Family Support Services program;

(qq) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Supported Child Development program;

(rr) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Aboriginal Supported Child Development program.

4 Section 29 (b) is amended by adding the following subparagraph:

(v) any warrants as described in section 14.2 (1) of the Act.

5 Section 62 (1) (d.3) is amended by striking out "paragraph (b) (i)" and substituting "paragraph (f)".

6 Section 62.2 (1) (d.1) is repealed and the following substituted:

(d.1) a dependant of a person referred to in paragraph (c) (ii), if the dependant was a dependant of the person on the date that person ceased to be eligible for disability assistance and remains a dependant of that person, .

7 Section 1 (a) of Schedule B is amended by repealing subparagraphs (xxi) and (xxiv) and adding the following subparagraphs:

(xl) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Family Support Services program;

(xli) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Supported Child Development program;

(xlii) payments granted by the government of British Columbia under the Ministry of Children and Family Development's Aboriginal Supported Child Development program, .

8 Section 1 of Schedule C is amended by adding the following definitions:
