B.C. Reg. 148/2019, deposited July 8, 2019, under the CHILD CARE SUBSIDY ACT [section 13]. Order in Council 403/2019, approved and ordered July 8, 2019.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended as set out in the attached Schedule.

Schedule

1 Section 9 (3) (b) of the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended by striking out "applies" and substituting "apply".

2 Section 9.1 is amended

(a) in subsection (1) by adding the following definition:

"new applicant" means a parent who

(a) is not currently receiving a child care subsidy, and

(b) has applied for a child care subsidy under section 4 but no determination has yet been made whether the parent is eligible for a child care subsidy. ,

(b) in subsection (3) (a) (i) (A) by striking out "in subsection (2) whose" and substituting "in subsection (2) of this section whose" and by striking out "with subsection (2) (b)," and substituting "with subsection (2) (b) of this section,",

(c) in subsection (4) by striking out "under subsection (3)" in both places and substituting "under subsection (3) of this section",

(d) by repealing subsection (5) and substituting the following:

(5) If an applicant is eligible for an increased amount of child care subsidy determined in accordance with subsection (4) of this section, the increased amount of child care subsidy may be paid as follows:

(a) in the case of a new applicant, from the first day of the month in which the parent completes an application under section 4;

(b) in all other cases, despite section 13 (1), from the first day of the month after the month in which the applicant requests an income review under this section. ,

(e) in subsection (6) (a) by striking out "under subsection (2) whose" and substituting "under subsection (2) of this section whose",

(f) in subsection (6) (a) (ii) by striking out "under subsection (3) using" and substituting "under subsection (3) of this section using",

(g) in subsection (7) (a) (i) (A) by striking out "in subsection (6) whose" and substituting "in subsection (6) of this section whose" and by striking out "with subsection (6) (b)," and substituting "with subsection (6) (b) of this section,", and

(h) in subsection (8) by striking out "subsection (7)" in both places and substituting "subsection (7) of this section".

3 Section 16 (1) is repealed and the following substituted:

(1) The minister may continue to pay a child care subsidy for child care provided in a licensed child care setting, a registered licence-not-required child care setting or a licence-not-required child care setting as follows:

(a) for a period of up to 2 weeks in one month but not for more than 4 weeks in total in one calendar year if a child is absent because the child is on vacation;

(b) for a period of up to 2 weeks in one month if the child is absent because the child or parent is ill.

4 The table in section 2 of Schedule A is amended in column 2 of item 10 by striking out "Care Surrounding School Day (children of school age)" and substituting "care surrounding school day".

5 The table in section 3 of Schedule A is amended in column 2 of item 5 by striking out "Care Surrounding School Day (children of school age)" and substituting "care surrounding school day".

6 The table in section 4 of Schedule A is amended in column 2 of item 4 by striking out "Care Surrounding School Day (children of school age)" and substituting "care surrounding school day".

7 The table in section 5 of Schedule A is amended in column 2 of item 5 by striking out "Care Surrounding School Day" and substituting "care surrounding school day".
