B.C. Reg. 268/2020, deposited November 9, 2020, under the EMPLOYMENT AND ASSISTANCE ACT [section 35 (2)] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [section 26 (2)]. Order in Council 580/2020, approved and ordered November 9, 2020.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in the attached Appendix 1,

(b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in the attached Appendix 2,

(c) effective January 1, 2021, the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in the attached Appendix 3, and

(d) effective January 1, 2021, the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in the attached Appendix 4.

Appendix 1

1 Section 2.1 of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(a) in subsection (2) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; ,

(b) in subsection (3) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; , and

(c) in subsection (4) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; .

2 Section 1 (a) (xlviii) of Schedule B is repealed and the following substituted:

(xlviii) compensation paid or payable under Division 5 [Compensation in Relation to Death of Worker] of Part 4 [Compensation to Injured Workers and Their Dependants] or section 225 [compensation in relation to worker death before July 1, 1974] of the Workers Compensation Act to a dependant, as defined in section 1 of that Act, who is a child, as defined in section 165 (1) of that Act; .

3 Section 6 (vv) of Schedule D is repealed and the following substituted:

(vv) compensation paid or payable under Division 5 [Compensation in Relation to Death of Worker] of Part 4 [Compensation to Injured Workers and Their Dependants] or section 225 [compensation in relation to worker death before July 1, 1974] of the Workers Compensation Act to a dependant, as defined in section 1 of that Act, who is a child, as defined in section 165 (1) of that Act; .

Appendix 2

1 Section 2.01 of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(a) in subsection (2) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; ,

(b) in subsection (3) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; , and

(c) in subsection (4) by adding the following paragraph:

(a.1) a benefit under the Canada Recovery Benefits Act; .

2 Section 29 (a) (iii) and (b) (vii) is amended by striking out "section 29 or 30 of the Workers Compensation Act" and substituting "section 191 [temporary total disability] or 192 [temporary partial disability] of the Workers Compensation Act".

3 Section 1 (a) (lii) of Schedule B is repealed and the following substituted:

(lii) compensation paid or payable under Division 5 [Compensation in Relation to Death of Worker] of Part 4 [Compensation to Injured Workers and Their Dependants] or section 225 [compensation in relation to worker death before July 1, 1974] of the Workers Compensation Act to a dependant, as defined in section 1 of that Act, who is a child, as defined in section 165 (1) of that Act; .

4 Paragraph (b) of the definition of "qualifying income" in section 3 (1) of Schedule B is amended by striking out "section 29 or 30 of the Workers Compensation Act" and substituting "section 191 [temporary total disability] or 192 [temporary partial disability] of the Workers Compensation Act".

5 Section 6 (zz) of Schedule D is repealed and the following substituted:

(zz) compensation paid or payable under Division 5 [Compensation in Relation to Death of Worker] of Part 4 [Compensation to Injured Workers and Their Dependants] or section 225 [compensation in relation to worker death before July 1, 1974] of the Workers Compensation Act to a dependant, as defined in section 1 of that Act, who is a child, as defined in section 165 (1) of that Act; .

Appendix 3

1 Section 3 (6) of Schedule B to the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(a) in paragraph (a) by striking out "$400" and substituting "$500",

(b) in paragraph (b) by striking out "$600" and substituting "$750", and

(c) in paragraphs (c) and (d) by striking out "$700" and substituting "$900".

Appendix 4

1 Section 3 of Schedule B to the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(a) in subsection (1) by repealing the definition of "base amount" and substituting the following:

"base amount" means

(a) $1 250, in the case of a family unit that includes only one recipient,

(b) $1 500, in the case of a family unit that includes two recipients, only one of whom is designated as a person with disabilities, and

(c) $2 500, in the case of a family unit that includes two recipients who are designated as persons with disabilities; , and

(b) by repealing subsection (8).
